JAKARTA, MKRI - The Constitutional Court (MK) declared the petition of Delpedro Marhaen Rismansyah, who is a General Election monitor from the Citta Loka Taru Foundation in the Dispute over the 2024 Nabire regent election results inadmissible. This was conveyed by the Chief Justice of the Constitutional Court, Suhartoyo, in the ruling hearing of case no. 225/PHPU.BUP-XXIII/2025 on Wednesday, February 5, 2025.
“[the Court] declare the petitioner’s petition is inadmissible,” stated Chief Justice Suhartoyo, accompanied by eight constitutional justices.
In the Court's consideration outlined by Constitutional Justice Arief Hidayat, the Citta Loka Taru Foundation is registered and accredited as a monitor for the Central Papua Governor Election. However, in relation to this case is the Nabire Regency KPU Decree No. 580 of 2024.
The Court considers the qualifications and requirements of election observers to file a petition, as stipulated in the provisions of Article 157 paragraph (4) of Law Number 10 the Year 2016 on the election of governors, regents, and mayors and Article 4 paragraph (1) of PMK Number 3 the Year 2024. Thus, the exceptions of the Respondent and Relevant Parties, which basically state that the Petitioner does not have legal standing to file a petition, are well-founded according to law.
“Although the Petitioner is an accredited observer, the Petitioner does not have legal standing to file the petition. This is because the 2024 Nabire regent election is not only followed by one pair of candidates,” said Justice Arief.
At the preliminary hearing held on Wednesday, January 15, 2025, the Petitioner accused the election organizers of committing violations in five polling stations (TPS). The violation resulted in a revote at TPS 7 in Oyehe (499 final voters), TPS 12 in Karang Mulia (465 final voters), TPS 9 in Karang Tumaritis (327 final voters), TPS 9 in Siriwini (614 final voters), and TPS 11 in Siriwini (462 final voters). The second allegation involved a violation of the neutrality of state officials and the state civil apparatus (ASN).
