Double Voters Unfounded, Petition on Pinrang Regent Election Dismissed

JAKARTA (MKRI) — On Wednesday, February 5, 2025, the Constitutional Court (MK) dismissed the petition during the ruling hearing on the 2024 Pinrang regent election results dispute. This case was filed by candidate pair 1 Ahmad Jaya Baramuli-Abdillah Natsir. The Court believed that the petition failed to meet the vote margin threshold which was stipulated in Article 158 of Law No. 10 of 2016 on the Regional Election Law as the formal requirement to file a petition.

“On the petition’s subject matter, [the Court] declares the Petitioners’ petition inadmissible,” said Chief Justice Suhartoyo at the ruling hearing alongside the other eight constitutional justices on Wednesday, February 5, 2025.

In its legal consideration, delivered by Constitutional Justice Arsul Sani, the Court explained that the Petitioners failed to substantiate the arguments in their petition, leading the Court to deem it legally unfounded. One of the Petitioners’ claims involved double voters and voters’ IDs outside Pinrang Regency in 179 polling stations. However, no evidence could convince the Court that the double voters, as referenced by the Petitioners, used their voting rights in two or more polling stations.

"The court did not find any certainty regarding the truth of the subject matter of the Petitioner's petition," said Justice Arsul.

Therefore, the Court found no reason to disregard Article 158 of the Regional Election Law. The Court also did not find any incidents that could be considered to have harmed the implementation of the 2024 Pinrang regent election, which could be used as a reason to override Article 158 regarding the Petitioners’ legal standing in filing a petition.

Justice Arsul stated that the vote margin between the Petitioners and the most-voted candidate pair was 12,970 votes, or 5.97% of the total votes. This exceeded the threshold for filing a petition for the Pinrang regent election, which was set at a maximum of 3,256 votes, equivalent to 1.5% of the total 217,064 valid votes.

Pinrang KPU: Conditional Voting Allowed for Unlisted Voters

The Petitioners Ahmad Jaya Baramuli-Abdillah Natsir, alleged violations that they claimed benefited the Relevant Party, Candidate Pair 2 Irwan Hamid-Sudirman Bungi. The Pinrang KPU certified the vote acquisition as follows: Candidate Pair 1 Ahmad Jaya Baramuli-Abdillah Natsir received 89,753 votes, Candidate Pair 2 Irwan Hamid-Sudirman Bungi received 102,723 votes, and Candidate Pair 3 Usman Marham-A Hastri T Wello received 24,588 votes.

In their petitums, the Petitioners requested the Court to annul the Pinrang Regency KPU Decree No. 1198 of 2024 on the certification of the regent election results. They also requested that the Court declare the correct votes according to their version: Candidate Pair 1 with 89,753 votes, Candidate Pair 2 with 0 votes, and Candidate Pair 3 with 24,588 votes. Alternatively, they requested the Court to order the Respondent to do a revote at all polling stations in Pinrang Regency by only including Candidate Pairs 1 and 3.
