JAKARTA (MKRI) – The Constitutional Court (MK) has made a ruling on the 2024 South Papua gubernatorial election results dispute on Wednesday, February 5, 2025. It decided to grant the Petitioners’ request to withdraw the petition. The verdict was delivered by Chief Justice Suhartoyo alongside the other eight constitutional justices at the ruling hearing.
Before reading the verdict, Chief Justice Suhartoyo explained that nine constitutional justices had held a justice deliberation meeting on January 31, 2025. At the meeting, it was concluded that the request to withdraw the case was legally justified and the Petitioners are not allowed to resubmit the petition.
“[The Court] grants the Petitioners’ request to withdraw the petition No. 185/PHPU.GUB-XXIII/2025,” said Chief Justice Suhartoyo delivering the verdict in the plenary courtroom.

At the preliminary hearing on Thursday, January 16, 2025, the Petitioners challenged the South Papua gubernatorial election because the area had not met the requirements to be established as a province.
The establishment of South Papua Province did not meet the administrative requirements stipulated in Article 35 Law No. 23 of 2014 on Regional Governments, which required a minimum of five regencies/cities to establish a province. Meanwhile, South Papua only consists of four districts: Merauke, Mappi, Boven Digoel, and Asmat Districts.
