JAKARTA (MKRI) – The Constitutional Court (MK) has made a ruling on the 2024 Kapuas regent election results dispute on Tuesday, February 4, 2025. It decided to grant the Petitioners’ request to withdraw the petition. The verdict was delivered by Chief Justice Suhartoyo and eight other constitutional justices at the ruling hearing on Tuesday, February 4, 2025.
“[The Court] grants the Petitioners’ request to withdraw the petition,” said Chief Justice Suhartoyo delivering the verdict.
Chief Justice Suhartoyo explained that the decision was made during the justice deliberation meeting on Thursday, January 30, 2025. Following this decision, Candidate Pair 3 Alfian Mawardi and Agati Sulie Mahyudin as the Petitioners are not allowed to re-submit a similar petition to the Court. Furthermore, a copy of the petition will be returned to the Petitioners through the Registrar's Office of the Court.
The withdrawal was made by the Petitioners’ legal counsel at the preliminary hearing. They submitted a withdrawal letter to panel 1, which was handling the case, for consideration.
In the revised petition document, the Petitioners filed a petitum requesting the Court to annul Kapuas Regency KPU (Elections Commission) Decree No. 1747 of 2024 concerning the certification of the 2024 Kapuas Regency election results. Besides, they requested the Court to order the Kapuas Regency KPU to conduct a revote at all polling stations throughout Selat, Mantangai, and Tamban Catur Districts.
