JAKARTA (MKRI) – The Constitutional Court dismissed the petition for Case No. 159/PHPU.BUP-XXIII/2025 on the 2024 Morowali regent election results dispute. This decision was delivered at the ruling hearing in the plenary courtroom on Wednesday, February 5, 2025. This hearing was presided over by Chief Justice Suhartoyo and the other eight constitutional justices.
“On the petition’s subject matter, [the Court] adjudicated, declares the Petitioners’ petition inadmissible,” said Chief Justice Suhartoyo.
Constitutional Justice Enny Nurbaningsih stated that the Petitioners’ arguments were legally groundless, leaving no basis for the a quo petition to postpone the validity of Article 158 of Law No. 10 of 2016 (Regional Election Law), which stipulates legal standing as a formal requirement for filing election result dispute petitions. Furthermore, the Court found no special incidents or conditions. Therefore, continuing the petition to evidentiary hearing was deemed irrelevant.
Furthermore, the Court stated that although the Petitioners were a candidate pair, they did not meet the requirements for filing a petition as stipulated in Article 158 paragraph (2) letter a of Law No. 10 of 2016. Therefore, the Court ruled that the Petitioners lacked legal standing to file the a quo petition. Consequently, the exceptions raised by the Respondent and the Relevant Party on the Petitioners’ lack of legal standing were deemed legally justified.

In this case, the Petitioners argued that three Morowali Regency KPU (Elections Commssion) officials had allegedly received hundreds of millions of rupiah in cash from the Relevant Party. Also, they stated that violations were also identified in the district election committee (PPK) in six districts. PPK members were suspected of offering to cooperate to manipulate the Morowali regent election, with an estimated value of Rp3.16 billion. As a result, several PPK members, including those from Central Bungku, West Bungku (two individuals), East Bungku, Bahodopi, and Bungku Pesisir Districts, were permanently dismissed by the Morowali Regency KPU.
The Petitioners also disclosed additional violations concerning voting in Labota Village. They stated that the ballots were marked outside the polling stations, specifically in a container located within the PT Tirta Jaya Bersaudara area. This allegation was supported by witnesses who testified to having directly experienced and witnessed the incident on voting day.
