JAKARTA (MKRI) — The Court dismissed the petition for Case No. 227/PHPU.BUP-XXIII/2025 on the 2024 Buru regent election results dispute, filed by Candidate Pair 1 Muhammad Daniel Rigan and Harjo Udanto Abukasim (Petitioners). Chief Justice Suhartoyo delivered the verdict at the ruling hearing for this case on Wednesday, February 5, 2025. In the legal considerations delivered by Constitutional Justice Enny Nurbaningsih, the description of the a quo posita resulted in unclarity.
"Regarding the description of the posita point (8) of the petition, which in essence states the consanguinity between the Buru Regency Elections Commission (KPU) and the Relevant Party, yet in the a quo argument, the Petitioners' posita ended up alleging addition of 1,700 [voters] without ID cards in the final voters list," added Justice Enny.
In another posita, the Petitioners also alleged vote reduction in Polling Station 20, but failed to include the names of the polling station, village, and district in which the violation took place. Therefore, the Court deems the a quo argument unclear.
"Therefore, based on the considerations described above, the posita of the Petitioners' petition becomes obscure or vague," Justice Enny stated.
Upon examining the posita, the Court discovered that the Petitioners did not request the Court to instruct the Respondent to conduct a revote, but instead a reelection.
In that regard, it is essential for the Court to assert the use of the term "reelection" had made the petitum vague or obscure and misaligned with the existing posita in the petition's subject matter. In Law No. 10 of 2016, the terms "reelection" and "revote" differed in meaning. The former demands that the entire election be reconducted from the beginning i.e. candidate pair registration, while the latter refers to an election phase conducted in the polling stations in the case of issues during the polling.
At the preliminary hearing, Candidate Pair 01 Muhammad Daniel Rigan–Harjo Udanto Abukasim (Petitioners) filed a petition concerning the Buru Regency election results dispute. They raised concerns about alleged fraud in seven districts and objected to the vote count results certified by the Buru Regency KPU.
