JAKARTA, MKRI - The Constitutional Court (MK) decided that it could not accept the petition for Dispute over the 2024 Pegunungan Bintang regent election results filed by Theodorus Sitokdana and Terianus Keduman. The Decision No. 228/PHPU.BUP-XXIII/2025 was read out by the Chief Justice of the Constitutional Court Suhartoyo, accompanied by eight other Constitutional Justices in the ruling hearing on Wednesday, February 5, 2025.

In the consideration pronounced by Constitutional Justice Saldi Isra, the Court stated that the Petitioners’ petition did not fulfill the formal requirements of the petition. Therefore, there was no hesitation for the Court to declare the Petitioners’ petition unclear or vague.

Justice Saldi stated that since the Court found the Petitioners’ petition to be obscure, other exceptions, the Respondent's response, the Relevant Party’s statement, Bawaslu’s statement, and the subject matter of the petition were not considered further.

“The arguments other than and the rest are not considered further because they are considered irrelevant,” stated Justice Saldi.

Candidate Pair Theodorus Sitokdana–Terianus Keduman (Petitioners) argued that they objected to receiving zero votes, as they were unable to participate as candidates in the 2024 Pegunungan Bintang regent election. The petition was presented at the preliminary hearing on January 15, 2025. The Petitioners had faced obstruction, threats, intimidation, and violence when attempting to deliver the physical files for nomination and candidate requirements to the Pegunungan Bintang Regency KPU (Elections Commission). These actions were allegedly carried out by supporters of Candidate Pair 03 Costan Oktemka–Kris Bakweng.

Therefore, the Petitioners requested the Court to order the Pegunungan Bintang KPU to carry out a revote in Pegunungan Bintang Regency and requested the Court to annul Pegunungan Bintang KPU Decree No. 1491 of 2024 concerning the certification of the 2024 Pegunungan Bintang Regency election results.
