Constitutional Court Declares Bintuni Bay Election Result Dispute Petition Inadmissible

JAKARTA, MKRI - The Constitutional Court (MK) declared the petition of Candidate Pair Number 2, Daniel Asmorom-Alimudin Baedu in the Dispute over the 2024 Bintuni Bay regent election results inadmissible. This was conveyed by the Chairman of the Constitutional Court Justice Suhartoyo in the ruling hearing of case number 101/PHPU.BUP-XXIII/2025 on Wednesday, February 5, 2025.

“[the Court] declared that the Petitioners’ petition is inadmissible,” stated Chief Justice Suhartoyo, accompanied by eight constitutional Justices.

Constitutional Justice Enny Nurbaningsih explained the Court's consideration, that the Petitioners in its petitum letter b did not include the word “along” which was intended as a limitation on the object, in this case, KPU Decree No. 77 of 2024. The limitation in the petition is important to show the extent to which the object is requested by the Petitioners. Moreover, petition letter c, which is formulated cumulatively by the Petitioners, orders the Teluk Bintuni Regency KPU to conduct re-voting in 76 polling stations (TPS). According to the Court, the formulation of the petition contradicts each other.

“Because if the object of the petition in the form of the certification of the election results has been canceled as a whole, then it is impossible for re-voting to be carried out only at some polling stations in some districts as requested by the Petitioners. Thus, the Respondent's exception and the Relevant Party's exception stating that the Petitioners’ petition is unclear or vague is reasonable according to law,” continued Justice Enny.

The preliminary hearing was held by Panel 3 on Wednesday, January 15, 2025. The Petitioners accused the Relevant Party of committing violations, including instances where several voters were found to have cast their votes at two different polling stations.
