JAKARTA (MKRI) – The Constitutional Court (MK) dismissed the petition on the 2024 Samosir regent election results dispute filed by Candidate Pair 01 Freddy Lamhot P Situmorang and Andreas Bolivi Simbolon. The decision for Case No. 214/PHPU.BUP-XXIII/2025 was read out by Chief Justice Suhartoyo alongside the other eight constitutional justices at the ruling hearing on Wednesday, February 5, 2025 in the plenary courtroom.
In its legal considerations, delivered by Deputy Chief Justice Saldi Isra, the Court stated that the Petitioners’ petition failed to meet the formal requirements. Therefore, the Court did not hesitate to declare the petition unclear and vague (obscuur).
After review, the Court found that the Petitioners did not clearly explain the error in the vote acquisition results determined by the Respondent. The Petitioners only listed the correct vote acquisition according to their claim, stating that their votes should be set at 50,000 votes. However, this was not accompanied by a clear description of where the votes were generated and where the violations occurred that caused the Petitioners’ votes to be reduced.
In addition, regarding the Petitioners’ argument about violations in the election, it has been proven that the Petitioners failed to explain the violations in detail, clearly, and with sufficient clarity. The Petitioners also failed to show a correlation between the alleged violations and the results of the vote acquisition for both themselves and the other candidate pairs. "Thus, there is no doubt for the Court to declare the Petitioners’ petition unclear or vague," said Saldi.

At the preliminary examination hearing, Samosir regent candidate pair 1 Freddy Lamhot P. Situmorang dan Andreas Bolivi Simbolon (Lamhot-Simbolon) objected to their vote difference with candidate pair 2 Vandiko Tomotius Gultom dan Ariston Tua Sidauruk (Vadiko-Aris) in the Samosir regent-vice regent election. The Petitioners suspected the buying of C6 forms at polling stations (TPS).
As such, in the petitum, the Petitioners requested the Court to order the Samosir Regency KPU (Election Commission) to do a revote at all polling stations in Samosir Regency by excluding Valdiko-Aris.
