JAKARTA (MKRI) – The Constitutional Court (MK) dismissed the petition for the 2024 Kaimana regent election results dispute filed by Candidate Pair 02 Freddy Thie and Sobar Somat Puarada. This decision for Case No. 254/PHPU.BUP-XXIII/2025 was delivered by Chief Justice Suhartoyo alongside the other eight other constitutional justices at the ruling hearing on Wednesday, February 5, 2025 in the plenary courtroom.
In its legal considerations, delivered by Deputy Chief Justice Saldi Isra, the Court stated that the Petitioners’ petition failed to meet the formal requirements. Therefore, the Court did not hesitate to declare the petition unclear and vague (obscuur).
Furthermore, Justice Saldi stated that since the Court considered the petition to be vague, other exceptions, the Respondent's response, the statement by the Relevant Party, the statement by Bawaslu (Election Supervisory Body), and the petition’s subject matter were not considered further.
“Arguments for the remainder will not be considered further, as they are deemed irrelevant,” stated Justice Saldi.

At the previous hearing, the Petitioners argued that the verification of the Relevant Party as regent-vice regent candidate pair is legally flawed since they did not meet the 10% threshold of vote representation. The contribution of the National Mandate Party (PAN) should not be taken into account since the party did not issue a letter to notify the withdrawal of their endorsement for the Petitioners and the coalition by the deadline on September 4, 2024. Therefore, the Petitioners requested that the Court disqualify the Relevant Party for not meeting the requirements as the 2024 Kaimana regent-vice regent candidates.
