JAKARTA (MKRI) – The Constitutional Court (MK) ruled the petition for case No. 251/PHPU.GUB-XXIII/2025 filed by Candidate Pair 1 Husain Alting Sjah-Asrul Rasyid on the 2024 North Maluku gubernatorial election results dispute inadmissible. The verdict was delivered by Chief Justice Suhartoyo at the ruling hearing on Wednesday, February 5, 2025.
In its legal consideration, delivered by Constitutional Justice Arief Hidayat, the Court asserted that the petition filed by the Petitioners failed to meet formal requirements as it was deemed unclear or vague (obscuur).
“Based on these reasons, there is no doubt for the Court to declare that the Petitioners’ petition is unclear or vague or obscuur. Thus, the Respondent’s or Relevant Party’s exceptions that the petition unclear or obscuur are legally justified,” said Chief Justice Suhartoyo.
Based on the above consideration, other exceptions such as the Respondent’s response, the testimony of the Relevant Party and Bawaslu (Elections Supervisory Body), and the subject matter were not considered further.

The Petitioners had alleged that a number of voters had used ID cards from 12 provinces outside the Province of North Maluku. However, this argument was said to be unfounded because the Petitioners could not describe the residential addresses of those voters alleged.
Also, the Petitioners were deemed to have ignored the provisions of Article 30 of Government Regulation No. 40 of 2019 on the Implementation of Law No. 23 of 2006 on Population Administration, which has been amended by Law No. 24 of 2013. The regulation stipulates the National Identity Number (NIK) as a single identity number is used for all public service affairs and is valid for life and does not change despite changes in domicile.
