JAKARTA (MKRI) — The Constitutional Court (MK) rendered the petition for Case No. 244/PHPU.BUP-XXIII/2025 on the Pegunungan Bintang regent election results dispute inadmissible for being vague (obscuur libel). The decree for the petition, filed by Candidate Pair 4 Thonce Nabyal–Jeremias Tapyor, was delivered in the ruling hearing chaired by Chief Justice Suhartoyo on Wednesday, February 5, 2025.
“[The Court] adjudicated, on the petition’s subject matter, declaring the Petitioners’ petition inadmissible,” stated Chief Justice Suhartoyo reading out the verdict along with the other eight constitutional justices.
In its legal considerations, delivered by Deputy Chief Justice Saldi Isra, the Court explained that the petition did not fulfill the formal requirements, thus the Court did not hesitate to declare the Petitioners' petition to be vague or obscure. For that reason, the remaining exceptions, the response from the Respondent and the statements from the Relevant Party and Election Supervisory Body (Bawaslu), and the petition's subject matter were not considered by the Court as there is no relevance.
'[The petition] did not meet the formal requirements, thus without hesitation the Court declares the Petitioners' petition to be obscure or vague," said Deputy Chief Justice Saldi Isra.

In the previous hearing, the Pegunungan Bintang regent-vice regent candidate pair 4 (Thonce Nabyal and Jeremias Tapyor) argued that the election lacked the principle of “one person, one vote”. The Pegunungan Bintang Regency KPU had issued a decree No. 1491 of 2024 certifying the regent election results as follows: candidate pair 1 with 13,864 votes, candidate pair 2 with 40,903 votes, candidate pair 3 with 15,730 votes, and candidate pair 4 with 26,754 votes.
In the petitum, the Petitioners requested the Court to annul the said decree and to order the Respondent a revote in all polling stations of Pegunungan Bintang regency.
