JAKARTA (MKRI) — The Constitutional Court (MK) ruled the petition for case No. 92/PHPU.BUP-XXIII/2025 on the 2024 Minahasa regent election results dispute inadmissible. The ruling for the petition, filed by Regent Candidate Pair 1 Susi Fiane Sigar-Perly George Steven Pandeiroot (Petitioners), was delivered on Tuesday, February 4, 2025.
'On the subject matter, [the Court] declares the Petitioners' petition inadmissible," said Chief Justice Suhartoyo in the plenary courtroom.
In reading the Court's legal considerations, Constitutional Justice Arief Hidayat noted the resignation of Regent Candidate 3 Robby Dondokambey from his position as a member of the North Sulawesi Regional Legislative Council (DPRD) for the 2024-2029 term. The Petitioners' argument on the indication of voter mobilization had also been discontinued by the Minahasa Elections Supervisory Body (Bawaslu). "The Court did not find any special condition or incident," said Justice Arief.
The Court finds no grounds to disregard the enforcement of Article 158 of Law No. 10 of 2016 on Regional Elections, which sets a 2-percent vote margin threshold for filing a petition. The Petitioners acquired 41,136 votes, which is 52,410 votes (27.9 percent) less than the Relevant Party, who obtained 93,546 votes.

At the preliminary hearing on Tuesday, January 14, 2025, Candidate Pair 01 Susi Fiane Sigar-Perly George Steven Pandeiroot (Petitioners) alleged an administrative violation by regent candidate 03 Robby Dondokambey, who had not resigned from his position as a member of the North Sulawesi DPRD (Legislative Council) for the 2024-2029 term.
In their petitums, the Petitioners requested the Court to disqualify Robby Dondokambey-Vanda Sarundajang from the election. They also requested that the Minahasa Elections Commission be ordered to conduct a revote for the 2024 Minahasa regent without the participation of the Relevant Party.
