JAKARTA (MKRI) — The Constitutional Court (MK) dismissed the petition by Candidate Pair Number 1 Arsalan Makalalag-Hartina S. Badu on dispute over the 2024 South Bolang regent election results. The Decision No. 11/PHPU.BUP-XXIII/2025 was delivered by the Constitutional Court (MK) on Tuesday, February 4, 2025.
“On the petition’s subject matter, [the Court] declares the Petitioners’ petition for case No. 11/PHPU.BUP-XXIII/2025 inadmissible,” said Chief Justice Suhartoyo reading out the verdict alongside the eight constitutional justices in the plenary courtroom.
In its legal considerations, delivered by Constitutional Justice Arief Hidayat, the Court explained that the Petitioners had not fulfilled the formal requirements of the petition, particularly with regard to the reasons for the petition, which were unclear or vague. “With regard to these reasons, there is no doubt for the Court to declare the petition unclear or vague or obscure,” said Justice Arief.

At the preliminary hearing on Tuesday, January 14, 2025, the Petitioners alleged state civil apparatus (ASN) and village apparatus had been involved in securing the win for the incumbent candidate number 2 (Relevant Party). Specifically, the Petitioners revealed that the head of the Education Office of South Bolaang Mongondow was found distributing Rp 50,000 to people who walked to the polling stations.
The Petitioners also alleged the KPPS organizers had been involved in influencing voters, while the election supervisory committee (Panwaslu) had overlooked the reported violations. It was also claimed that the village head had intimidated voters to support candidate pair 02.
