JAKARTA (MKRI) – The Constitutional Court (MK) dismissed the petition for case No. 49/PHPU.BUP-XXIII/2025 on the 2024 North Konawe regent election results dispute. The verdict was delivered by Chief Justice Suhartoyo alongside the other eight constitutional justices at the ruling hearing on Tuesday, February 4, 2025 in the plenary courtroom.
“[The Court] adjudicated, on the petition’s merit, to dismiss the Petitioners’ petition No. 49/PHPU.BUP-XXIII/2025,” asserted the chief justice.
The Court asserted that the petition filed by Candidate Pair 2 Sudiro-Raup did not meet the formal requirements of the petition. The petition was also declared unclear (obscuur).
“There is no doubt for the Court to declare the Petitioners’ petition to be unclear or vague or obscuur,” said Chief Justice Suhartoyo.
Thus, the exceptions of the North Konawe Regency KPU (Elections Commission) as the Respondent and Candidate Pair 1 Ikbar-Abu Haera as the Relevant Party, that the Petitioners’ petition was unclear, was considered by the Court to be legally justified. Furthermore, the Respondent’s response, the Relevant Party’s testimony, the North Konawe Bawaslu’s (Election Supervisory Body) testimony, and the petition’s merit were not considered further.

At the preliminary hearing, the Petitioners argued that the Respondent had shown partiality as an election organizer, in the form of a campaign billboard that read “Vote for Number 1.” The Petitioners also brought up the issue of the civil servants’ partiality and the practice of vote buying in almost all election areas. The ASN partiality argued by the Petitioners includes an active regent who has a kinship with the Relevant Party.
The Petitioners requested the Court to annul the North Konawe KPU decree regarding the certification of the 2024 North Konawe regent election results. The Petitioners also requested that the Court order a revote at all polling stations in North Konawe Regency.
