JAKARTA (MKRI) — On Tuesday, February 4, 2025, the Constitutional Court (MK) ruled the petition for case No. 57/PHPU.BUP-XXIII/2025 on the 2024 Melawi regent election results dispute inadmissible. The decision for the case, filed by regent-vice regent candidate pair 1 Kluisen and Iif Usfayadi, was delivered by Chief Justice Suhartoyo alongside the other eight constitutional justices in the plenary courtroom.

In its legal considerations, delivered by Constitutional Justice Arsul Sani, the Court asserted that the Petitioners did not satisfy the formal requirements of filing the petition. As such, the Court declared the Petitioners’ petition obscured.

Therefore, the Court did not further consider other exceptions, the Respondent’s response, the Relevant Party’s statement, Bawaslu’s (Elections Supervisory Body) statement, and the petition’s subject matter.

“Other arguments and matters were not further be considered as they were irrelevant,” said Justice Arsul.

The Petitioners deemed Candidate Pair 2 Dadi Sunarya Usfa Yursa and Malin not eligible to participate in the election due to structured, systematic, and massive (TSM) violations. Some forms of the violations include: impartiality of civil state apparatus, village heads, village officials, and village consultative body, KPU (General Elections Commission), and Bawaslu. These, the Petitioners argued, affected the vote difference between them and Dadi-Malin.
