Petition by Jimat-Aku for Subang Regent Election Dismissed

JAKARTA (MKRI) - The Constitutional Court (MK) dismissed the petition filed by Candidate Pair 01 Ruhimat and Aceng Kudus (Jimat-Aku) for case No. 62/PHPU.BUP-XXIII/2025 on the Subang regent election results dispute. The verdict was read out at a ruling hearing in the plenary courtroom on Tuesday, February 4, 2025, presided over by Chief Justice Suhartoyo alongside the other eight constitutional justices.

“On the petition’s subject matter, [the Court] adjudicated, declares the Petitioners’ petition inadmissible,” said Chief Justice Suhartoyo.

Constitutional Justice M. Guntur Hamzah explained that the decision was made because the vote margin between the Petitioners and candidate pair Reynaldy Putra Andita Budi Raemi-Agus Masykur Rosyadi (Relevant Party) did not meet the required threshold. According to Article 158 paragraph (2) letter d of Law No. 10 of 2016, the vote margin should not exceed 0.5 percent or 4,019 votes.

However, the Petitioners obtained 299,809 votes, while the Relevant Party received 430,725 votes. As a result, the vote margin between the two amounted to 130,916 votes, or 16.29 percent.

“Considering the legal considerations above, according to the Court, despite the Petitioners being a candidate pair for regent and vice regent in the 2024 Subang regent election, the Petitioners did not meet the requirements for filing the petition,” said Justice Guntur.

In addition to the threshold, the Court also addressed the petition’s argument regarding the inconsistent year of birth of regent candidate Reynaldi Putra Andita Budi Raemi (Relevant Party) on candidacy requirements documents. The Court stated that the Petitioners’ argument was addressed by the Respondent’s answer, the statement of the Relevant Party, and the statement from the Subang Regency Bawaslu (Elections Supervisory Body), in accordance with the determination from the Subang District Court.

“Thus, according to the Court, the arguments in the a quo petition were legally groundless,” said Justice Guntur.

At the preliminary examination hearing on January 8, 2025, the Petitioners expressed allegations of vote buying, or money politics in several polling stations committed in a structured and systematic manner. The Petitioners also argued over the indications of administrative violation by Reynaldy Putra Andita Budi Raemi, whose years of on their birth certificates and diplomas differ.

For the reasons above, the Petitioners requested the Court to revoke the Subang Regency KPU Decree No. 1862 of 2024 on the certification of the 2024 Subang Regency regent election results. They also requested the Court to disqualify candidate pair Reynaldy Putra Andita Budi Raemi and Agus Masykur Rosyadi and to order the Subang Regency KPUD  to conduct a revote at all polling stations.
