Obscure, Sungai Penuh Election Dispute Petition Dismissed

JAKARTA (MKRI) — The Constitutional Court (MK) declared the petition by Candidate Pair Number 2 Ahmadi Zubir and Ferry Satria dismissed. The Decision No. 71/PHPU.WAKO-XXIII/2025 regarding the dispute over the 2024 Sungai Penuh City mayor election results was pronounced by the Chief Justice Suhartoyo, accompanied by the other eight constitutional justices in the ruling hearing on Tuesday, February 4, 2025 in the plenary courtroom.

In its legal considerations, delivered by Constitutional Justice Arsul Sani, the Court stated that the petition did not fulfill the formal requirements. Therefore, there was no doubt for the Court to state that the petition was unclear, vague, or obscuur.

Justice Arsul Sani said that because the Court deemed the petition vague, other exceptions, the Respondent’s response, the Relevant Party’s statement, Bawaslu’s (Elections Supervisory Body) statement, and the subject matter of the petition were not considered further.

“Other arguments and other matters were not considered further because they were considered irrelevant,” he said.

The Petitioners argued that Candidate Number 1 Alfin and Azhar Hamzah had committed three violations that were structured, systematic, and massive (TSM). The violations in question included civil servant partiality, intimidation, and the partiality of election organizers. Thus, the Petitioners requested the Court to disqualify Candidate Pair Number 1.
