OKU Regent Election Dispute Dismissed Due to Unclear Petition

JAKARTA (MKRI) – The Constitutional Court (MK) dismissed the petition for case No. 14/PHPU.BUP-XXIII/2025 on the 2024 North Konawe regent election results dispute filed by Candidate Pair 1 Yudi Purna Nugraha-Yenny Elita. The verdict was delivered by Chief Justice Suhartoyo and eight other constitutional justices at the ruling hearing on Tuesday, February 4, 2025. 

Further, Chief Justice Suhartoyo explained that this petition did not meet the formal requirements for the petition. Hence, the Court surely declares that the Petitioners’ petition is unclear or vague. Thus, the Respondent and Related Party's exceptions stating that the Petitioners’ petition is unclear are legally justified.

“[The Court] adjudicated, on the exception: reject exceptions regarding the authority of the deadline of the petition submission. In the petition’s merit, [the Court] dismisses the petition,” said Chief Justice Suhartoyo while reading out the verdict, accompanied by Deputy Chief Justice Saldi Isra and seven other constitutional justices.

In the preliminary hearing on Thursday, January 9, 2025, the Petitioners requested that the Court annul the Ogan Komering Ulu KPU Decree No. 1355 of 2024 on the certification of the 2024 Ogan Komering Ulu regent election results, dated December 2, 2024. The Petitioner alleged violations occurred before, during, counting, and recapitulation of vote count result. The Respondent’s data outlines the vote count results, 104,778 and 198,587, respectively for candidate pairs 01 (Yudi Purna Nugraha-Yenny Elita) and 02 (Teddy Meilwansyah-Marjito Bachri), noting a margin of 93,809 votes between the two pairs.

According to the Petitioners, the difference in votes occurred due to violations and fraud at the pre-election stage, the alleged violations are in creating the self-image of Candidate Number 02 (Relevant Party) by abusing authority, programs, and activities. The examples of the alleged violations are: road improvement program in East Baturaja and Lengkiti, the use of local government facilities, and the involvement of ASN.

As such, the Petitioner requested that the Court order the OKU Regency KPU to conduct a revote of the OKU regent-vice regent transparently, excluding Candidate Pair 02 Teddy Meilwansyah-Marjito Bachri, at least in the villages of Baturaja Lama, Air Paoh, Kemalaraja, Tanjung Baru, Pasar Baru, Sekar Jaya, Sepancar Lawang Kulon, Kemelak Bindung Langit (East Baturaja District); Talang Jawa, Saung Naga (West Baturaja District); Gunung Meraksa, Muara Jaya, Surau, Beringin, Muara Saeh, Lubuk Tupak, Karang Lantang, (Lubuk Batang District); and Suka Pindah, Bunglai, and Kedaton (Kedaton Peninjauan Raya District).
