JAKARTA (MKRI) — The Constitutional Court (MK) dismissed the petition for case No. 60/PHPU.WAKO-XXIII/2025 on the 2024 Payakumbuh mayoral election results dispute. The ruling for this case, filed by mayor-vice mayor candidate pair 1 (Supardi and Tri Venindra), was delivered by Chief Justice Suhartoyo along with the other eight constitutional justices in plenary courtroom on Tuesday, February 4, 2025.
“[The Court] adjudicated, on the petition’s subject matter, declaring the Petitioners’ petition inadmissible,” stated Chief Justice Suhartoyo reading out the verdict.
The Court highlighted the votes margin between the Petitioner and the Relevant Party candidate pair 3 (Zulmaeta and Elzadaswarman).
Based on Article 158 paragraph (2) letter a of Law No. 10 of 2016, the vote difference between the Petitioners and the Relevant Party needed to be a maximum of 2 percent (or 1,229 votes) for the Petitioners to file a regional election results dispute. The Petitioners received 15,459 votes, while the Relevant Party received 21,207 votes, resulting in a difference of more than 2 percent.
“The votes margin between the Relevant Party and the Petitioners is 21,207 votes or equivalent with 9.39 percent,” asserted Constitutional Justice M. Guntur Hamzah delivering the consideration.
As not meeting the provision of Article 158, the Petitioners did not have legal standing to file the petition.
“The Petitioners lacked legal standing to file the a quo petition. As such, the Respondent’s and the Related Party’s exceptions, asserting the Petitioners’ lack of legal standing to be legally sound,” explained Constitutional Justice M. Guntur Hamzah.

At the preliminary hearing on January 10, 2025, the Petitioners alleged TSM violations occurred in five districts. The TSM violation in question was the collection of identity cards (KTP) and family cards (KK) of the voters. Voters were each given a sheet of a “mandate letter.” They were also given Democrat Party member cards and the United Development Party (PPP) member cards. The Petitioners said that the mandate letter was intended to make it appear as if those who had been registered would act as mandate witnesses at polling stations (TPS).
In its petitums, the Petitioners requested that the Court cancel the Payakumbuh City KPU Decree Number 636 of 2024 on the certification of the 2024 Payakumbuh mayoral election results, disqualify the Relevant Party, and order the Respondent to conduct a revote at all polling stations in Payakumbuh.
