JAKARTA (MKRI) — The Constitutional Court (MK) ruled the petition for case No. 122/PHPU.BUP-XXIII/2025 on the 2024 North Halmahera regent election results dispute inadmissible. The decree for the petition’s withdrawal, filed by regent-vice regent candidate 3 Matheus Stefi Pasimanjeku-Abdul Aziz Hakim, was delivered by Chief Justice Suhartoyo along with the other eight constitutional justices on Tuesday, February 4, 2025.
“On the petition’s subject matter, [the Court] rules the Petitioners’ petition inadmissible,” stated Chief Justice Suhartoyo delivering the ruling in the plenary courtroom.
In its legal consideration, delivered by Constitutional Justice Enny Nurbaningsih, the Court declared the petition lacking valid evidence and list of evidence supporting the petition, thus failing to comply with Article 31 paragraph (2) of Law No. 7 of 2020 and Article 8 paragraph (1) letter c of Constitutional Court Regulation No. 3 of 2024. The failure to include evidence was also not in line with the provisions of Article 8 paragraph (1) letter c of the Constitutional Court Regulation No. 3 of 2024.
“Despite the Court being authorized to examine the Petitioners’ petition [and] the petition was filed during the designated period, it failed to meet the formal requirements. As such, the exceptions of the Respondent and the Relevant Party, and the Petitioners’ petition will not proceed [to the evidentiary hearing],” explained Justice Enny.

In the petitums, the Petitioner argued election violations by North Halmahera regent candidate 4 Piet Hein Babua. The candidate in question allegedly performed cybersex with a woman through his phone.
This misconduct, Abdul continued, was unacceptable for Piet Hein Babua as a regent candidate, considering North Halmahera strongly upholds religious values and local customs.
