Lack of Vote Margin, Muaro Jambi Election Dispute Dismissed

JAKARTA (MKRI) – The Constitutional Court (MK) dismissed the petition for case No. 139/PHPU.BUP-XXIII/2025 on the 2024 Muaro Jambi Regency election results dispute. The Court stated that it was because the vote margin exceeded 2% of the total valid votes. The decree was delivered by Chief Justice Suhartoyo, accompanied by eight other constitutional justices, on Tuesday, February 4, 2025.

In the legal considerations read by Deputy Chief Justice Saldi Isra, the Court stated that the vote margin between the Petitioners and the Relevant Party was 12,681 votes, equivalent to 5.5%. Therefore, the Court concluded that the Petitioners do not have the legal standing to file the petition.

Saldi further stated that the Court was not convinced of the validity of the Petitioners’ main petition. Thus, in this case, the Court should stick to the provisions of Article 158 of Law 10/2016 regarding the Petitioners’ legal standing.

“After the Court read the Petitioners’ petition, heard the testimony of the Respondent, Bawaslu (election supervisory body), and the Relevant Party, as well as studied the evidence submitted, the Court found the arguments unconvincing, indicating those were legally groundless,” said Deputy Chief Justice Saldi.

Furthermore, he stated that the Court believed that the 2024 Muaro Jambi regent election was conducted as per the established procedures and provisions. Additionally, regarding the a quo petition, the Court found no special conditions or incidents that could be considered to have affected the proper execution of the 2024 Muaro Jambi regent election.

“Hence, the Court found it is irrelevant to pursue this a quo petition to the evidentiary hearing,” asserted Deputy Chief Justice Saldi.

At the preliminary hearing on Tuesday, January 14, 2025, Candidate Pair 2 Zuwanda and Sawaluddin (Petitioners) argued the prevalence of ineligible voters in the 2024 Muaro Jambi regent election.


Such a violation allegedly occurred due to the fact that many people had not received their ID cards (e-KTP). Yet, those people were allowed to vote anyway. The Petitioners believe that it has resulted in the vote inflation of certain candidate pairs. The Muaro Jambi KPU was alleged to have enabled the violation, harming the Petitioners’ votes and benefiting other candidates.
