Decree in Absence Issued for Lingga Regent Election

JAKARTA (MKRI) — The Constitutional Court (MK) declared a decree in absence for the petition by Candidate Pair Number 2 Alias Wello-Muhammad Ishak for the 2024 Lingga regent election results dispute Case No. 116/PHPU.BUP-XXIII/2025. The decree was read out by the Chief Justice Suhartoyo, accompanied by eight constitutional justices in the plenary courtroom.

Prior to the pronouncement of the decree, Constitutional Justice Arief Hidayat stated that during a justice deliberation meeting, it had been concluded that the Court should issue a decree in absence for the petition. “A decree in absence [is handed down for the petition],” said Chief Justice Suhartoyo on Tuesday, February 4, 2025.

At the preliminary hearing on Wednesday, January 8, 2025, neither the Petitioners nor his legal counsel was present. The petition states that candidate pair number 1, Muhammad Nizar-Novriza, had allegedly abused their authority to benefit the Relevant Party. Some of these abuses of authority include the use of the regional budget grant program through the Indonesian Red Cross (PMI) of Lingga Regency to win candidate pair number 1.

The Petitioners also accused the incumbent candidate of having committed corruption of the Lingga Regency Regional Government Budget, which was then used as a ticket to run for the 2024 Lingga regent election. The allegation was based on Exhibit P-27, which showed a 34-minute video of Muhammad Nizar with the chairman of the Lingga Regency DPRD (Regional Legislative Council) for the 2019-2024 period, Ahmad Nashirudin.
