Court Dismisses Banjar Regency Election Petition by Syaifullah-Bahasyim

JAKARTA (MKRI) The Constitutional Court (MK) ruled the petition for Case No.64/PHPU.BUP-XXIII/2025 on the 2024 Banjar regent election results dispute, filed by Candidate Pair Number 2 Syaifullah Tamliha and Habib Ahmad Bahasyim, inadmissible. The Court was of the opinion that the Petitioners’ petition was unclear or obscuur libel.

“On the petition’s subject matter, [the Court] declares the Petitioners’ petition No. 64/PHPU.BUP-XXIII/2025 inadmissible,” stated Chief Justice Suhartoyo at the ruling hearing on Tuesday, February 4, 2025.

Constitutional Justice Arsul Sani explained that the Court was of the opinion that Case No. 64/PHPU.BUP-XXIII/2025 did not fulfill the formal requirements of the petition, therefore there was no doubt for the Court to declare the petition unclear, vague, or obscure. The Court was of the opinion that the subject matter of the petition was not considered further.

“The Petitioners for case No. 64/PHPU.BUP-XXIII/2025 did not fulfill the formal requirements of the petition, therefore there is no doubt for the Court to declare the Petitioners’ petition unclear, vague, or obscuur,” Justice Arsul stated.

Candidate Number 2 Syaifullah Tamliha and Habib Ahmad Bahasyim as the Petitioners argued that Candidate Number 1 Saidi Mansyur and Said Idrus (Relevant Party) had misused authority, programs, and activities. Banjar regent Saidi Mansyur as an incumbent candidate in the 2024 election had allegedly conducted a covert campaign by attaching the word “MANIS”—the pair’s campaign tagline or slogan—and his personal image as an incumbent to government facilities.

The Petitioners requested that the Court annul the KPU (General Elections Commission) Decree No. 2152 of 2024 on the certification of the 2024 regent election results dated December 4, 2024. They also petitioned that the Court disqualify Candidate Pair 01 from the election or to instruct the Banjar KPU to conduct a revote at all of the polling stations in the regency.
