JAKARTA (MKRI) — Case No. 191/PHPU.BUP-XXIII/2025 on the 2024 Waropen regent election results dispute was declared outside of the Constitutional Court’s (MK) jurisdiction. This decree was read out by Chief Justice Suhartoyo alongside the other eight constitutional justices at the ruling hearing on Tuesday, February 4, 2025 in the plenary courtroom.

“[The Court adjudicated], states that the Constitutional Court was not authorized to hear the Petitioners’ petition,” Chief Justice Suhartoyo delivered the verdict.

Constitutional Justice Ridwan Mansyur stated that during a justice deliberation meeting, it had been concluded that the Petitioners’ petition had no relation to the annulment of the Waropen Regency Elections Commission (KPU) Decree No. 588 of 2024.

“Thus, the Petitioners’ petition focused on the draft of the Waropen KPU Decree No. 498 of 2024 has the wrong object. Thus, the Petitioners' petition was outside of the Court’s jurisdiction,” Justice Ridwan said.

At the preliminary hearing, the Petitioners had disputed the use of the noken system in the 2024 Waropen regent election even though Waropen Regency is not within areas that should be using the system. Therefore, the Petitioners requested that a revote be carried out at 19 polling stations in Kirihi District, 19 in Urei Faisei District, and 1 in Wonti District.

(*) The noken voting system is carried out by communities in Papua, either through public agreement on vote allocation or through the delegation of votes to a tribal leader.
