JAKARTA (MKRI) — The Central Jakarta District Court Decision No. 73/Pdt.Sus-PKPU/2020/PN Niaga.Jkt.Pst is not related to Regent Candidate Number 01 Sashabila Widya L. Mus. The party declared bankrupt in the decision is her father, Ahmad Hidayat Mus. Furthermore, the Jakarta District Court Decision No. 28/Pdt.SusGLL/2021/PN Niaga.Jkt.Pst, the Supreme Court Decision No. 927 K/Pdt.SusBankrupt/2022, and the Supreme Court Decision No. 17 PK/Pdt.Sus-Bankrupt/2023 did not declare Sashabila Widya L. Mus bankrupt.
The Taliabu Island Regency KPU’s (Respondent) legal counsel Hendra Kasim made the statement at the examination hearing for the dispute over the 2024 Taliabu Island regent election results on Friday, 24, 2025. The hearing was presided over by Chief Justice Suhartoyo (panel chair) and Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah on panel 1. The examination hearing was scheduled to hear the Respondent’s response and testimonies by the Relevant Party and Bawaslu (Elections Supervisory Body).
The Respondent responded to the claim made by Candidate Pair Number 03 Abidin Jaaba dan Dedy Mirzan (Petitioners) by issuing Clarification No. 76.1/PL.02.2- BA/8208/2/2024 concerning the results of clarification of candidate requirements documents in the 2024 Taliabu Island regent election, dated September 20, 2024. The Respondent clarified that there had never been a court decision declaring Sashabila Widya L. Mus bankrupt.
“Therefore, Sashabila Widya L. Mus is proven not to have liabilities that are detrimental to state finances and is not in a state of bankruptcy,” stated Hendra in response to Case No. 221/PHPU.BUP-XXIII/2025.
Misinterpretation
The Relevant Party’s (Candidate Number 01 Sashabila Widya L. Mus - La Ode Yasin) legal counsel Rifyan Ridwan Saleh explained that the Petitioners had misconstrued the interpretation of the Jakarta Commercial Court Decision No. 73/Pdt.Sus-PKPU/2020/PN.Jkt.Pst dated July 6, 2020.
“In the case in question, there is no statement that the Relevant Party is declared bankrupt and then there is not a single court decision that states Sashabila Widya L. Mus a legal subject declared bankrupt and/ or has liabilities that are detrimental to state finances,” explained Rifyan.
Bawaslu: No Findings
La Umar La Juma from the Taliabu Island Regency Bawaslu stated that Bawaslu had found no reports or findings regarding the bankruptcy status of Sashabila Widya L. Mus. “So, for this [issue], there is no follow-up by Bawaslu in its supervision,” stated La Juma.

At the preliminary hearing on Tuesday, January 14, 2025, the Petitioners argued that the nomination process of Candidate Number 01 Sashabila Widya L. Mus should be considered formally flawed because she had been declared bankrupt by the Central Jakarta Commercial Court. Therefore, from the beginning, she did not fulfill the formal requirements to be appointed as a candidate for the 2024 Taliabu Island regent election. The Central Jakarta District Court Decree stated that Ahmad Hidayat Mus was declared bankrupt. One of the assets that became the object of bankruptcy in the form of a certificate of ownership (SHM) is in the name of Salshabila Widya L. Mus.
For this reason, the Taliabu Island Bawaslu reminded the Taliabu Island KPU of the need for a certificate of never having been declared bankrupt. However, the Respondent continued to certify Salshabila Widya L. Mus as a candidate in the 2024 Taliabu Island regent election. Therefore, the Petitioners requested the cancellation of the Taliabu Island Regency KPU Decree No.188 of 2024 concerning the certification of the 2024 Taliabu Island regent election results.
The Petitioners requested the Court order the Taliabu Island Regency KPU to disqualify Candidate Number 01 Sashabila Widya L. Mus and La Ode Yasir; to order the Taliabu Island Regency KPU to conduct a revote of the 2024 Taliabu Island regent election no later than two months after the Court renders its decision by involving only Candidate Number 02 and Candidate Number 03.
