Raja Ampat KPU Responds to Allegation of Partisanship

JAKARTA (MKRI)The Raja Ampat Regency Elections Commission (KPU) as Respondent denied the argument of Candidate Pair Number 2 Hasbi Suaib and Martinus Mambraku (Petitioners) that the difference between the Petitioners and Candidate Pair Number 1 Orideko Iriano Burdam and Mansyur Syahdan (Relevant Party) was caused by the partisanship of state civil apparatus (ASN). The Respondent argued the Petitioners should have reported the alleged violation to the Civil Service Commission (KASN) no later than 7 days after receiving the report from the public.

The statement was made by the Respondent’s legal counsel Akhmad Jazuli at the examination hearing for Case No.148/PHPU.BUP-XXIII/2025 regarding the dispute over the 2024 Raja Ampat regent election results on Wednesday, January 22, 2025. The hearing was scheduled to hear the Respondent’s response and testimonies by the Relevant Party and Bawaslu (Elections Supervisory Body) as well as to validate evidence. It was presided over by Deputy Chief Justice Saldi Isra and Constitutional Justices Ridwan Mansyur and Arsul Sani on panel 2.

Jazuli also stated that if the alleged violation had occurred before the certification of the election participants, the report should have been filed to the National Civil Service Agency (BKN). If the alleged violation had occurred after the certification of the election participants, the report should have been filed to Bawaslu.

The Relevant Party’s legal counsel A. Muhammad Asrun also denied the Petitioners’ argument regarding ASN’s partiality in the 2024 Raja Ampat regent election. Asrun stated that the argument was made up without any details, while based on the regent KWK C-result copy form, the Petitioner’s witness did not submit any C-incident form and/or objection had signed the form regent KWK C-result copy form.

“This petition does not explain where alleged violations occurred,” Asrun argued.

The Respondent and the Relevant Party requested the Court to reject the Petitioners’ petition in its entirety and to affirm the validity of the Raja Ampat KPU decree on the certification of the vote acquisition results in the 2024 Raja Ampat regent election.

Raja Ampat Bawaslu’s legal counsel Irwan Rumbara testified on the ASN’s partiality, explaining that they had handled the violation based on a report by Karyadi, Jamaludin Rumattiga, and Agustinus Jihelmin. However, after they conducted a review of the report, the regional secretary as the reported party was not proven to have committed the violation.
