JAKARTA (MKRI) - The Petitioner of Case No. 204/PHPU.WAKO-XXIII/2025 has formally withdrawn the petition on the Probolinggo mayoral election results dispute at a hearing on Monday, January 20, 2025. The hearing was intended to hear responses/testimonies from the Respondent, the Relevant Party, and Bawaslu (Elections Supervisory Body), as well as to validate evidence. The withdrawal was submitted by the Petitioner, an observer of the 2024 Probolinggo mayoral election, represented by Saparuddin, the national coordinator of the Indonesian Voters Association (PPI).
The hearing was presided over by Chief Justice Suhartoyo (panel chair) and Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah on panel 1. The Respondent in the case was the Probolinggo Elections Commission (KPU).
At this hearing, the Petitioner was absent. Meanwhile, the Probolinggo KPU (Respondent) and the Probolinggo Bawaslu were present.
“We, the Court, cannot confirm whether the Petitioner’s absence indicates approval of the withdrawal or a lack of seriousness in pursuing the petition,” stated Chief Justice Suhartoyo.
As a result, the Probolinggo election results dispute hearing was discontinued. “For [Case No.] 204, we have decided not to proceed with this petition,” announced Chief Justice Suhartoyo.

At the previous hearing on Thursday, January 9, 2025, Saparuddin alleged structured, systematic, and massive (TSM) violations had occurred, due to the involvement of state civil apparatus (ASN). The Petitioner highlighted instances of practical political activities by ASN that demonstrated bias toward one of the Probolinggo mayor-vice mayor candidates.
The Petitioner requested the Court to annul the Probolinggo KPU Decree No. 366 of 2024 on the certification of the 2024 Probolinggo mayor election results, and to order the Probolinggo KPU to conduct a revote.
