KPU Gresik: Genpabumi Not Registered as Election Observers

JAKARTA, MKRI - The Pribumi Unity Movement (Genpabumi) has no legal standing to file a petition of the 2024 Gresik Regent Election Result Dispute. Because the Petitioner does not qualify as an Election Observer as stipulated in Article 4 paragraph (3) of PMK 3/2024.

The clarification was conveyed by the Gresik Regency KPU in the hearing session of the dispute of the 2024 Gresik Regent Election result on Friday, January 17, 2025. The hearing was also to listen to the Respondent's answer as well as the testimony of Bawaslu and the Relevant Parties and presided over by Panel of Justice 1 led by Chief Justice Suhartoyo (panel chair) and Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah.

The Gresik Regency KPU (Respondent) through its legal counsel, M. Faiz Putra Syanel, explained that the KPU Decree Number 2727 of 2024 on the certification of The 2024 Gresik Regent Election Result that determined the five Regent Election Monitors.

“The petitioner is not registered as an Election Observer, because there are only five registered observers as follows: Poros Sahabat Nusantara (POSNU) chaired by Abdur Rosyid Bahruddin; Independent Election Monitoring Committee chaired by Maslukhin; Netfid Gresik chaired by M. Ali Ma'sum; Voter Education Network for Gresik People chaired by Wayut Vandiki Cahyaka; and the Indonesian Women's Coalition (KPI) chaired by Maslukhin. Ali Ma'sum; Voter Education Network for Gresik People headed by Wayut Vandiki Cahyaka; and the Indonesian Women's Coalition (KPI) Gresik headed by Duta Bintan Fitriyah,” explained Faiz in the hearing of the Case Number 131/PHPU.BUP-XXIII/2025.

Letter of Agreement

Meanwhile, the Relevant Party through Achmad Saiful explained that the Petitioner was not registered as an Election Observer in the 2024 Gresik Regent Election. The basis for the Petitioner to file this Regent Election Results Dispute petition is the joint agreement letter made by the Petitioner and the Respondent on June 19, 2024.

“So that the joint agreement letter must still be followed up by the Respondent in the form of a decision letter so that the Petitioner has legal standing. But in fact, the Petitioner is not registered as an election monitor. Therefore, it is appropriate for the Court to decide that the Petition is rejected or at least declared inadmissible,” said Saiful.

In the preliminary hearing on Wednesday, January 8, 2025, the Petitioner filed for the cancellation of the KPU Decree Number 2752 of 2024 on the certification of the 2024 Gresik Regent Election Result dated December 4, 2024. The Petitioner stated that the votes of Candidate Pair Number 01 Fandi Ahmad Yani and Asluchul Alif are 366,944. Meanwhile, The vote acquisition of the Empty Box was 247,479 votes, with several invalid votes reaching 35,749 votes the total number of voting rights 650,172, and the final voter's list (DPT) 971,740.

The defeat of the Empty Box, according to the Petitioner, was caused by the absence of maximum socialization from the KPU to the community, especially in 12 sub-districts, including Driyorejo Sub-district, Palongpanggang Sub-district, Wringin Anom Sub-district, Kedamean Sub-district, Menganti Sub-district, Benjeng Sub-district, Cerme Sub-district, Duduk Sampeyan Sub-district, Dukun Sub-district, Panceng Sub-district, Sangkapura Sub-district, and Tambak Sub-district. Therefore, the Petitioner requested that the Court order the KPU of Gresik Regency to declare the Empty Column as the winner. Then request the Court to order the KPU of Gresik Regency to conduct re-election in Menganti District, Driyorejo District, Wringin Anom District, Cerme District, Benjeng District, and Balongpanggang District.
