JAKARTA, (MKRI) - Central Mamberamo Regency Regent Candidate Number 02, Yonas Kenelak, is deemed not to meet the physical and mental health requirements as stipulated in Article 14 paragraph (2) letter e of PKPU 8/2024 on the Nomination of Governors and Deputy Governors, Regents and Deputy Regents, and Mayors and Deputy Mayors. As a result, the Petitioner, in their petition, has requested the annulment of Central Mamberamo KPU Decree Number 428 of 2024 on the certification of the 2024 Central Mamberamo Regent Election Result. This issue was one of the arguments raised by Candidate Pair Number 03, Eremen Yogosam and Berius A. Kogoya, during the Preliminary Hearing of the Dispute on Thursday, January 16, 2025.
“Candidate for Regent of Central Mamberamo Regency Number 02 Yonas Kenelak is considered to be physically and mentally unfit. This is evident at the time of conducting a medical examination at the Regional Hospital, the person concerned was physically pushed in a wheelchair and could not walk on his own, but the assessment and examination team appointed by the Central Mamberamo Regency KPU stated that he was physically and mentally qualified and capable of the Candidate for Regent of Central Mamberamo Regency Number 02 Yonas Kenelak” explained Eduard.
In front of Chief Justice Suhartoyo (panel chair) and Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah on panel 1, Eduard Nababan the petitioner’s legal counsel mentioned the vote acquisition of each candidate pair in The Petition Case Number 250/PHPU.BUP-XXIII/2025 as follows: Candidate Pair Number 01 Egypt Jikwa - Aruam Pagawak received 8,393 votes, Candidate Pair Number 02 Yonas Kenelak - Itaman Thago received 20,628 votes, and the Petitioner received 8,946 votes, with a total of 37,967 valid votes. However, according to the Petitioner, the correct votes for each candidate pair should be, Candidate Pair Number 01 Egypt Jikwa - Aruam Pagawak 7,069 votes, Candidate Pair Number 02 Yonas Kenelak - Itaman Thago 5,152 votes, and the Petitioner 7,627 votes.
The Petitioner argued that the difference in vote acquisition was because, the voting in Ilugwa and Eragayam Districts was not conducted based on the provisions of the legislation, so the two districts should conduct a re-voting, the petitioner’s witness was also not given a copy of C.Result.KWK, so the witness never signed the minutes of the event until the Open Plenary Meeting of Certification of Vote Acquisition of Regent Election Results on December 5, 2024. The witness was never given an invitation by the district election committee/PPD. Therefore, the Petitioner requests the Court order the Respondent to conduct re-voting in Eragayam District and Ilugwa District, Central Mamberamo Regency, Papua Mountain Province.
