JAKARTA (MKRI) – Mamberamo Raya regent-vice regent candidates 03 Ever Mudumi and Mada Marlince Rumaikewi filed petition for the annulment of Mamberamo Raya Election Commission (KPU) Decree No. 250 of 2024 on the certification of the 2024 Mamberamo Raya regent election results. The preliminary examination hearing for Case No. 282/PHPU.BUP-XXIII/2025 was presided over by Chief Justice Suhartoyo (panel chair) and Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah on Wednesday, January 15, 2025.
The Petitioners, through their legal counsel, La Ode M. Rusliadi Suhi, stated that the carelessness of the Mamberamo KPU (Respondent) in not accepting the candidate pair supported by a coalition of political parties not included in the Regional Legislative Council (DPRD) was considered to have ignored the Constitutional Court Decision No. 60/PUU-XXII/2024 dated August 20, 2024. This decision was used as a reference in the candidacy requirements for the Mamberamo Raya regent-vice regent candidate pairs through political parties.
According to the Petitioners, there were six political parties (PKB, Garuda, PKS, UMMAT, PKN, and Gelora) that did not have seats in the DPRD, and the Respondent followed up on this through KPU Decree No. 50 concerning the certification of the 2024 Mamberamo Raya legislative council members election results. Due to the Respondent's fraud and negligence, candidate pair Terianus Levin Bisararisi–Samuel Alle, nominated by the coalition, was not accepted by the KPU. This occurred because the coalition of supporting political parties lacked seats in the DPRD.
"The Petitioners argue that the Respondent's actions violate Article 157, paragraph (9) of Law No. 10 of 2016, rendering the Mamberamo Raya KPU Decree No. 131 of 2024 on the certification of final regent-vice regent candidates of Mamberamo Raya Regency, Papua Province, legally flawed and invalid," stated Rusliadi in the plenary courtroom.
The Petitioners mentioned that, according to the Respondent, Candidate Pair 01 Robby Wilson Sumansara–Kevin Totow received 11,648 votes; Candidate Pair 02 Matius Fuyeri–Dius Enumbi obtained 5,970 votes; Candidate Pair 03 (Petitioners) gained 2,847 votes; and Candidate Pair 04 Alfon Sesa–Yakobus Britai secured 5,551 votes, totaling 21,040 valid votes. However, the Petitioners asserted that the Respondent acted unprofessionally in administering the voting process at all polling stations across the regency.
For instance, the Respondent initially conducted the vote count at the polling stations using a plywood board, followed by the use of C-Plenary Results and C- Copy Results forms. Subsequently, vote inflation was allegedly committed by the polling station working committee (KPPS) and the campaign team of Candidate Pair 01 to secure their victory. As a result, the Petitioners refused to sign the D- Results forms.
Based on the aforementioned arguments, the Petitioners requested that the Court annul the Mamberamo Raya KPU decree on the certification of the 2024 Mamberamo Raya regent-vice regent candidates, as it no longer meets the legal requirements and contradicts the law governing the 2024 Mamberamo Raya regent election. The Petitioners further requested that the Court instruct the Mamberamo Raya KPU to reopen registration for Mamberamo Raya regent-vice regent candidates through political parties not having seats in the DPRD, in accordance with the Constitutional Court's decision.
