JAKARTA (MKRI) - Pohuwato regent-vice regent candidates 01 Yusri M. Helingo and Fatmawaty Syarief (Petitioners) argued that there were discrepancies between the C1 form for the regent election and the C1 form for the governor election of Gorontalo, despite both forms being based on the same final voter registration list (DPT). The Petitioners highlighted that the Pohuwato Election Commission (KPU) as the Respondent uploaded the C1 form for the regent election from TPS 2 in Telaga Village, Popayato District, which they claimed contained inconsistencies.
Such an argument was delivered by Ferdinansyah Nur as the legal counsel before Constitutional Justices Arief Hidayat (panel chair), Anwar Usman, and Enny Nurbaningsih on panel 3in the panel 3 courtroom. The preliminary examination hearing for Case No. 37/PHPU.BUP-XXIII/2025 on the Pohuwato regent election results dispute was held on Tuesday afternoon, January 14, 2025.
Ferdinansyah further emphasized that there was an administrative violation as outlined in Article 71, paragraph (2) of Law Number 10 of 2016. "We contend that there was a violation regarding the official transfer conducted six months prior. We previously submitted this matter to the Election Supervisory Body (Bawaslu), but it was not registered. Subsequently, we pursued legal action at the Manado High Administrative Court and appealed to the Supreme Court. The Supreme Court has issued a verdict rejecting the appeal." stated Ferdiansyah.
In addition, the Petitioners argued that the incumbent regent, Saipul A. Mbulga, had transferred Awaludin Jefri Pakaya, who had previously served as the manager of regional assets at the Communication, Informatics, and Statistics Office, to the position of service data processor at the Wanggarasi district office in Pohuwato.
Therefore, the Petitioners requested in their petitum that the Court annul the Pohuwato KPU Decree No. 1376 of 2024, dated December 4, 2024, on the certification of the 2024 Pohuwato regent election results and certify the vote acquisition dated December 3, 2024.
"[We request the Court to] order the Respondent to conduct a revote in all problematic polling stations across the regency. [We also request the Court to] order the Respondent to cross out Candidate Pair 02 because they are considered not to meet the requirements as candidates for regent and deputy regent of Pohuwato," said Ferdinansyah.
