JAKARTA, MKRI - Two Candidates for Regent and Deputy Regent have filed a petition to cancel the Decision of the General Election Commission (KPU) of Sabu Raijua Regency Number 599 of 2024 concerning the Certification of the 2024 Election Results of Regent and Deputy Regent of Sabu Raijua Regency dated December 2, 2024. The two petitioners are Candidate Pair Number 1 Simon Petrus Dira Tome-Dominikus Dadi Lado and Candidate Pair Number 3 Yohanis Uly Kale-Leonidas V.C. Adoe.
The Preliminary Hearing of Case Number 300/PHPU.BUP-XXIII/2025 was held by Panel 3 presided over by Constitutional Justice Arief Hidayat, accompanied by Constitutional Justices Anwar Usman and Enny Nurbaningsih on Tuesday, January 14, 2025. However, Justice Arief explained that the Sabu Raijua Regency KPU Decree Number 599 of 2024 was issued on December 2, 2024. Meanwhile, the Petitioner only filed the petition on December 18, 2024, on the grounds that the Petitioner was waiting for the issuance of a certificate of non-bankruptcy from Candidate Pair Number 2 Krisman Bernard Riwu Kore and Thobias Uly on December 19, 2024.
“Well, that's what I said earlier, it should have been filed according to the three-day grace period, the correction is also three days, if this is the case, it has passed the time. So this does not fulfill the formal requirements as a petition,” Constitutional Justice Arief said in Panel Courtroom 3, Jakarta, on Tuesday, January 14, 2025.
Nevertheless, Constitutional Justice Arief still allowed the Petitioner’s legal counsel, Bram Perwita Anggadatama, to convey the principal petition and petitum of Case Number 300/PHPU.BUP-XXIII/2025. Bram himself said that the two Petitioners questioned the certificate of non-bankruptcy of candidate pair number 2, Krisman Bernard Riwu Kore-Thobias Uly.
Bram explained that Krisman Bernard Riwu Kore was not registered as a party who filed a certificate of not being bankrupt to the Surabaya District Court or Commercial Court. Even though the letter is seen as decisive evidence it has serious implications for fulfilling the nomination requirements.
The absence of a certificate of non-bankruptcy should make Krisman Bernard Riwu Kore ineligible (TMS) as a candidate for the regent of Sabu Raijua Regency. As referred to in Article 7 paragraph (2) letter I of Law Number 10/2016 on the Second Amendment to Law Number 1/2015 on the Stipulation of Government Regulation in Lieu of Law Number 1/2015 on the Election of Governors, Regents, and Mayors (Pilkada Law).
.“So [the absence of certificate of non-bankcruptcy] (violation of) nomination requirements,” said Bram.
In their petitum, the Petitioners asked the Court to annul the Decree of the KPU of Sabu Raijua Regency Number 599 of 2024 on the Certification of the 2024 Election Results of the Regent and Deputy Regent of Sabu Raijua Regency dated December 2,2024. In addition, the Petitioners asked the Court to declare the disqualification of Krisman Bernard Riwu Kore-Thobias Uly from participating in the Pilbup of Sabu Raijua Regency.
Furthermore, declaring null and void the Decision of the KPU of Sabu Raijua Regency Number 367 of 2024 concerning the Certification of Candidate Pairs for the Regent and Vice Regent Elections of Sabu Raijua Year 2024 dated September 22, 2024, insofar as it relates to the Krisman Bernard Riwu Kore-Thobias Uly pair. Declare void the Decision of the KPU of Sabu Raijua Regency Number 368 of 2024 concerning the Certification of the Number of Candidate Pairs for the Election of Regent and Vice Regent of Sabu Raijua Year 2024 dated September 23, 2024, insofar as it relates to the Krisman Bernard Riwu Kore-Thobias Uly pair.
The Petitioner also requested the Court to order the Sabu Raijua Regency KPU to conduct a re-vote (PSU) across all polling stations. This re-vote, the Petitioner proposed, should only involve Candidate Pair Number 1, Simon Petrus Dira Tome-Dominikus Dadi Lado, and Candidate Pair Number 3, Yohanis Uly Kale-Leonidas V.C. Adoe.
