Jayapura Mayoral Election Campaign Allegedly Linked to State Budget

JAKARTA (MKRI) – Candidate Pair 03 Boy Markus Dawir-Dipo Wibowo argue that Candidate Pair 02 Jony Banua Rous-Drwis Massi had provided and promised goods through a government program funded by the state budget (APBN). They claimed to have reported these violations to both the Jayapura City Bawaslu (Elections Supervisory Body) and the Papua Province Bawaslu during the campaign period but received no response from either.

“The alleged TSM (structured, systematic, and massive) violations during the campaign period should have led to the disqualification of Candidate Pair 02, preventing them from participating as election candidates,” stated the Petitioners’ legal counsel Achmad Jaenuri at the preliminary hearing for Case No. 279/PHPU.WAKO-XXIII/2025 concerning the Jayapura mayoral election results dispute in the Constitutional Court (MK) on Tuesday, January 14, 2025. This case was heard by Deputy Chief Justice Saldi Isra (panel chair) and Constitutional Justices Ridwan Mansyur and Arsul Sani on panel 2.

The Petitioners stated that the government program in question, sourced from the state budget, is the self-sufficient development stimulus assistance (BSPS) provided by the Ministry of Public Works and Public Housing (PUPR), which involves house renovations in five districts with assistance from state civil apparatus (ASN). The Petitioners argued that Candidate Pair 02 had claimed the BSPS program as their initiative, creating the impression that they were able to use the state budget for personal interests.

Additionally, Candidate Pair 02 promised several central government programs, including an energy assistance program from the Ministry of Energy and Mineral Resources, which involved distributing rice cookers, public street lighting assistance program, and financial support for places of worship. The Central Bawaslu has issued a directive for the Papua Province Bawaslu and the Jayapura City Bawaslu to address the violation report submitted by the Petitioners. However, the Jayapura City Bawaslu has yet to take any action.

The Petitioners believe there were signs of the Jayapura City Bawaslu’s partiality, as their report regarding objections to the non-recapitulation of the vote count and the transfer of ballot box contents into containers was dismissed. Furthermore, the Petitioners stated that the public was unable to access the supervision results conducted by the Papua Province Bawaslu and the Jayapura City Bawaslu, including the A- supervision forms.

The Jayapura KPU Decree No. 457 of 2024 dated December 11, 2024 certifies the Jayapura City mayoral election results as follows: Candidate Pair 01 Frans Pekey-Mansur received 26,105 votes, Candidate Pair 02 Jony Banua Rouw-Darwis Massi obtained 68,922 votes, Candidate Pair 3 Boy Markus Dawir-Dipo Wibowo received 28,019 votes, and Candidate Pair 4 Abisai Rollo-Rustan Sarru gained 72,351 votes.

Therefore, the Petitioners requested the Court to declare the KPU decree null and void; to declare that Candidate Pair 02 Jony Banua Rouw-Muh Darwis Massi have been legally and convincingly proven to have committed fraud, violations, and abuse of power, warranting their disqualification as mayoral candidates of Jayapura; to order the Jayapura City KPU to conduct a revote across the city, excluding Candidate Pair 02 and only involving Candidate Pairs 01, 03, and 04.
