Election Observer Withdraws Fakfak Election Dispute Petition

JAKARTA (MKRI) Deputy Chief Justice Saldi Isra stated that Petitioner for Case No. 144/PHPU.BUP-XXIII/2025, the Fakfak Regency election observer represented by Saparuddin, has officially withdrawn their petition. Therefore, it will not be continued.

“It means that this case will not be continued. We declare this case closed. This will be certified later and will be reported at the justice deliberation meeting,” said Deputy Chief Justice Saldi Isra, who chaired the preliminary hearing for the dispute over Fakfak Regency election results on panel 2 alongside Constitutional Justices Ridwan Mansyur and Arsul Sani, on Tuesday, January 14, 2025.

In the petition, Saparuddin questioned the Fakfak Regency Bawaslu (Elections Supervisory Body) concerning the recommendation of administrative violations to the Fakfak Regency KPU (Elections Commission) to annul Candidate Pair Untung Tamsil-Yohana Dina Hindom. The Fakfak Regency KPU (Respondent) has conducted a legal review and concluded that Bawaslu’s recommendation met the provisions of the law.

However, the West Papua Provincial KPU then released a decree on the annulment of the Fakfak Regency KPU decree on the certification of the 2024 Fakfak Regency election candidate pairs. At the same time, Candidate Pair 01 Untung Tamsil-Yohana Dina Hindom filed a lawsuit to the Supreme Court (MA) regarding the cancellation of their candidacy by the Fakfak Regency KPU.

The Petitioners believe that the West Papua KPU decree to cancel the decision of the Fakfak KPU and the Supreme Court’s decision did not touch on the election issue, which is the election violations based on the Fakfak Bawaslu’s recommendation, which were detrimental to voters. The Fakfak KPU decree on Fakfak Bawaslu’s recommendation to cancel Candidate Pair 01 was canceled by the West Papua KPU, allowing Untung Tamsil-Yohana to run in the election.

The Fakfak KPU certified the vote acquisition as follows: Candidate Pair 01 Untung Tamsil-Yohana Dina Hindom with 20,818 votes and Candidate Pair 02 Samaun Dahlan-Donatus Nimbitkendik with 24,775 votes. However, the Petitioners requested the Court to annul the certification of the vote acquisition as stated in the Fakfak KPU Decree No. 2831 of 2024 dated December 6, 2024 and to order the Fakfak KPU to carry out a revote in Fakfak Regency.
