Lamandau Election Result Dispute: Intimidation and Threats at Polling Stations

JAKARTA (MKRI) — The Lamandau regent candidate pair 1 Hendra Lesmana dan Budiman argued that the campaign team of candidate pair 2, Aditya Putra and Abdul Hamid, was involved in intimidation and threats during the voting. The Petitioner has reported these intimidation and threats to the Lamandu Regency Election Supervisory Body (Bawaslu) who ignored, even dismissed the report.

“The Petitioner reported such violations to Lamandau Bawaslu, but they did not follow up and even rejected the report,” said the Petitioner’s legal counsel, Isnaldi in the preliminary hearing of the regent election results dispute case No. 96/PHPU.BUP-XXIII/2025 on Monday, January 13, 2025, in panel 3 courtroom. Deputy Chief Justice Saldi Isra chaired this hearing with Constitutional Justices Ridwan Mansyur and Arsul Sani.

The Petitioner stated that such intimidation violated Article 69 of the Law of Election of Governors, Regents, and Mayors (Pilkada Law). In addition, the Petitioner alleged that the Lamandau Bawaslu head sided with candidate pair 2 (the Related Party), evidenced by the meeting of Bawaslu head with the campaign team leader of the said candidate to discuss campaign strategy to secure election victory.

The Petitioner stated that a voter named Devinda, who was about to vote at polling station 015 (SDN 6 Nanga Bulik), Nanga Bulik Village, Bulik subdistrict, was intimidated by a woman claiming to be from the candidate pair 2’s campaign team. She snatched Devinda’s resident ID and asked, “How much did you get paid to vote for [candidate pair] 1?” Another voter, Florinda, a civil servant (PNS) at the Lamandau education office, was visited by Abidin Noor as the candidate pair 2’s campaign team. He intimidated Florinda by saying civil servants should not vote for candidate pair 1, or they would be transferred by candidate pair 2.

The Lamandau Regency General Election Commission (KPU) has certified the vote count, showing candidate pair 1 (Hendra Lesmana-Budiman) with 27,640 votes and candidate pair 2 (Rizky Aditya Putra-Abdul Hamid) with 28,755 votes. The Petitioner claimed that violations by the Commission significantly affected the electability of the candidate pairs.

For instance, the Petitioner argued that there was a vote calculation error where the votes for the candidate pairs 1 and 2 did not match the counted ballots, so they reduced the number of invalid ballots by one and excluded them in the minutes. In addition, there were four additional voters who used resident IDs, but were not on the attendance list. This incident occurred at polling station 01 at Nanga Bulik Village, Bulik subdistrict.

In their petitum, the Petitioner requests the Court to annul the Lamandau Regency KPU Decree No. 812 on the certification of the 2024 election results of the Lamandau regent-vice regent dated December 4, 2024, as relevant to the votes in the 25 polling stations mentioned by the Petitioner. The Petitioner also wishes the Court to order the Lamandau Regency KPU for a revote in the said 25 polling stations. (*)
