JAKARTA (MKRI) – The Constitutional Court (MK) held a preliminary hearing presided over by Chief Justice Suhartoyo (panel chair) and Constitutional Justices Foekh and M. Guntur Hamzah concerning the 2024 Kapuas Regency election results dispute on Monday, January 13, 2025.
The Petitioners for Case No. 186/PHPU.BUP-XXIII/2025 was Candidate Pair 03 Alfian Mawardi and Agati Sulie Mahyudin, while the Kapuas Regency KPU (election commission) became the Respondent and Candidate Pair 01 Muhamad Wiyatno-Dodo became the Relevant Party.
However, the Petitioners withdrew their petition in the preliminary hearing. It was stated by their legal counsel, Darul Huda Mustaqim.
“Your Honor, for case 186 of Kapuas Regency, the Petitioners through their legal counsel today submit the withdrawal of the petition, Your Honor,” said Darul Huda.
The Court verified that there were no changes to the composition of the Petitioners’ legal team in this case. After confirming this, the withdrawal letter was submitted to the Justice of Panel 1 and subsequently reviewed by the Court.
“Alright, 186 withdrawn. We will consider,” said Chief Justice Suhartoyo.
During the preliminary hearing, the Court received a list of evidence from the Petitioners. However, with the withdrawal of the case, the evidence was considered irrelevant.

In the revised petition document, the Petitioners filed a petitum requesting the Court to annul Kapuas Regency KPU Decree No. 1747 of 2024 concerning the certification of the 2024 Kapuas Regency election results.
Besides, they requested the Court to order the Kapuas Regency KPU to conduct a revote,”In all polling stations throughout Selat, Mantangai, and Tamban Catur Districts,” as written in the revised petition document.
