Sabar-Sukardi Reveal Violation Against Requirements for Pasaman Regency Election

JAKARTA (MKRI) – Candidate for vice regent of Pasaman No 01 Anggit Kurniawan Nasution was convicted and provided fake information in the nomination document. Then, Candidate 02 Mara Ondak did not resign as a state civil apparatus during the nomination as a participant in the 2024 Pasaman Regency election.

The aforementioned points were revealed by Candidate Pair 03 Sabar AS-Sukardi (the Petitioners) in the preliminary hearing presided over by Chief Justice Suhartoyo (panel chair) and Constitutional Justice Foekh and M. Guntur Hamzah on panel 1 for case No. 16/PHPU.BUP-XXIII/2025 concerning the 2024 Pasaman Regency elections results.

In the preliminary hearing, the Petitioners’ legal counsel Yandi Sudarso explained that Anggit was once convicted under Decision No. 293/Pid.B/2022/PN JKT.SEL. citing the dishonesty which breaks the ethics of democracy. Even further, the South Jakarta District Court issued a letter of cancellation of the statement of never being a convict to the person concerned. Therefore, the Petitioners has reported to the election supervisory body (Bawaslu) as a report of alleged administrative violation of candidate requirements and also submitted to the Pasaman Regency KPU with the status of a report of election administrative violations.

Status as Civil Servants

The Petitioners also revealed that Candidate 01 Mara Ondak did not qualify for the requirements as a candidate as she did not officially resign from a civil servant position. She even got paid until November 2024. It proves that Mara Ondak was still a civil servant when she registered in the 2024 Pasaman Regency election. In short, the Respondent has certified candidate pair 01 and 02 as election candidates without fact-checking. Therefore, the Respondent is deemed to have been negligent in carrying out administrative duties and violating applicable regulations.

“The Respondent was negligent in nominating the candidate 01 Mara Ondak for the Pasaman Regency candidate because she did not fulfill the requirements and was still a civil servant”. Yandri Sudarso asserted.

Therefore, the Petitioners requested the annulment of the Pasaman Regency KPU Decree No. 851 of 2024 concerning the certification of the 2024 Pasaman Regency election results dated December 2, 2024; ordering the Pasaman Regency KPU to certify the Candidate Pair 03 Sabar AS-Sukardi as the elected candidate pair for the 2024 Pasaman Regency election.
