Pasaman Vice Regent Candidate’s Letter of No Criminal Conviction Questioned

JAKARTA (MKRI) - Pasaman regent-vice regent candidates 02 Mara Ondak and Desrizal alleged administrative issues in the 2024 Pasaman regent election results dispute. Mara-Desrizal are the Petitioners for Case No. 02/PHPU.BUP-XXIII/2025. The the preliminary examination hearing on Friday, January 10, 2025 was presided over by Chief Justice Suhartoyo (panel chair) and Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah.

In this case, the Pasaman KPU (Elections Commission) is the Respondent, while Pasaman regent-vice regent candidates 01 Welly Suhery and Anggit Kurniawan Nasution are the Relevant Party.

The Petitioners contested the Certificate of No Criminal Conviction No. 370/SK/HK/VIII/2024/PN.Jkt.Sel, submitted by the Relevant Party to the South Jakarta District Court on August 16, 2024. The Petitioners argued that, contrary to the certificate, the Relevant Party had a prior conviction for fraud.

“According to information from the South Jakarta District Court case tracking information system, excerpts of the decree reveal that vice regent candidate Anggit Kurniawan Nasution was previously convicted of fraud,” stated legal counsel Anasmen, presenting the argument.

The Petitioners acknowledged reporting the findings to the Pasaman Bawaslu (Elections Supervisory Body). However, Bawaslu issued a notification on the report status dated September 29, 2024, stating that the reported act did not constitute a violation and, therefore, would not be pursued further.

The Petitioners argued that Bawaslu had issued the report status without verifying the facts with the South Jakarta District Court or the South Jakarta Metro Police. They emphasized that the eligibility requirements for regional head candidates must be factually, accurately, and thoroughly verified by the Respondent and closely monitored by Bawaslu.

“However, in reality, the Pasaman regent election intentionally disregarded the fulfillment of the eligibility requirements for the regional head candidate Anggit Kurniawan,” said Amnasmen.

Meanwhile, the South Jakarta District Court issued a cancellation of Certificate No. 338/WKPN.W10-U3/HK.01/XI/2024 dated November 20, 2024, declaring the certificate of no criminal conviction presented by the Relevant Party invalid. Regarding this cancellation, the Petitioners argued that the Relevant Party should have been disqualified from the election due to a formal defect in their candidacy.

“Therefore, the certification of Anggit Kurniawan Nasution as Pasaman vice regent candidate 01 must be declared unlawful and nullified,” he stated.

Based on the arguments, the Petitioners filed a petitum requesting the Court to annul the Pasaman KPU decree on the certification of the 2024 Pasaman regent election results. Furthermore, the Petitioners requested the Court to disqualify the Relevant Party and invalidate their vote count.

“[We request the Court] to certify that the votes obtained by Pasaman regent and vice regent candidates 01 Welly Suhery and Anggit Kurniawan Nasution are invalid,” he said.

In response, the Court mandated the Respondent, the Relevant Party, and the Pasaman Bawaslu to present their responses at the next hearing.
