JAKARTA (MKRI) – The Constitutional Court (MK) held a preliminary hearing for the 2024 Pasangkayu regent election results dispute in panel 3 courtroom on Thursday, January 9, 2025. The Case Number 72/PHPU.BUP-XXIII/2025 was lodged by Lembaga Pemantau Gerak Langkah Indonesia (Indonesian Progression Monitoring Institute) represented by Putrawan Suryatno and Aprisal.

The Petitioners highlighted the fact that 1 (one) candidate pair ran in regency election. Thus, Candidate Pair Yaumil Ambo Djiwa and Herny went against a blank vote—an alternative choice meaning the voters’ rejection of the sole candidate pair.

“The victory of Candidate Pair Yaumil Ambo Djiwa and Herny was obtained through several modes of systematic, structured, and massive (TSM) violations starting from abuse of authority, misappropriation of government budget and programs, and the involvement of the regency government officials,” said Putrawan Suryatno as one the Petitioners at the hearing.

According to him, 27 villages spread across 10 districts were swayed under the instructions of the Pasangkayu KPU (Elections Commission). The polling station working committees (KPPS), he said, instructed the polling committee officers to be inaugurated using black prayer caps and red hijabs that share likeness with the tagline of the candidate pair.

In the petition, Putrawan also deemed it dangerous that the Pasangkayu Bawaslu (Elections Supervisory Body) as an election law enforcement agency had tolerated the election organizers’ violations. As a result, the Pasangkayu KPU officers committed violations easily without fear of punitive sanctions.

The regional government structure was also involved in violations in a massive and planned manner, where department heads and village and district heads were involved in political games. Putrawan claimed that the incumbent pair had no reluctance to influence voters and went so far as appropriating the government budget for their political interests.

In the petitums, he requested that the Court grant the petition for its entirety and annul the Pasangkayu KPU Decree No. 758 of 2024 on the certification of the 2024 regent election results. He also requested the Court order the Pasangkayu KPI to issue a decree on a revote in 2025.
