JAKARTA (MKRI) Rote Ndao Candidate Pair 02 Vicoas Trisula Bhakti Amalo-Bima Theodorianus Fanggidate argued that vice regent candidate Apremoi Dudelusi Dethan had violated formal requirements related to GED diploma. Therefore, the Petitioners requested the Court to eliminate Candidate Pair 01 from the 2024 Rote Ndao regent election.

“The letter from the head of the Rote Ndao Education Office that we just received a few days ago is close to the response of the head of the Rote Ndao Education Office when he was tried in the State Administrative Court Case No. 34, which stated that his diploma was illegal and unregistered,” said legal counsel Birri At Tamami Effendi at the preliminary hearing for Case No. 111/PHPU.BUP-XXIII/2025 concerning the regional election on Thursday evening, January 9, 2025 in a panel courtroom. The preliminary hearing was presided over by Deputy Chief Justice Saldi Isra (chair) and Constitutional Justices Ridwan Mansyur and Enny Nurbaningsih on panel 2.

With Candidate Pair 01 Paulus Henuk-Apremoi Dudelusy Dethan disqualified, the Petitioners expect the Court to order a revote in Rote Ndao Regency. The Petitioners explained that the discrepancy in the spelling of the name between the certificate of national examination results for the social sciences program for the 2013/2014 academic year dated September 20, 2014 issued for Apremoi Dudelusy Dethan and the GED diploma issued for Apremos Dudelusy Dethan was due to administrative oversight, which was not directly attributable to Dethan.

The Petitioners had found Dethan’s diploma that she had used to run as a Rote Ndao vice regent candidate was fake when compared to the other diplomas from the OENGGAE Community Learning Center (PKBM) and PKBM ITA ESA, where the diplomas were signed by the same head of the education office, signed at the same time, and stamped by the same office. However, only Dethan’s GED diploma had a different stamp and/or seal of the head of the related office.

They argued that submitting a forged diploma while running as a candidate in the regional election is a formal violation. Therefore, the Rote Ndao KPU (Election Commission, Respondent) has failed and been negligent in implementing the regulations during document checking and verification, which constitutes formal requirements for someone to be able to run as a regional head candidate.

The Petitioners said that this problem had been discussed since the nomination stage. They and the community had repeatedly made efforts to get clarification of this fact, but the Respondent as the election organizer had not yet provided legal certainty regarding the validity of the diploma and had certified said candidate in the election.
