JAKARTA (MKRI) — The Constitutional Court (MK) held a preliminary hearing of the Case Number 152/PHPU.BUP-XXIII/2025 filed by Deli Serdang Regent Candidate Pair 3 M. Ali Yusuf Siregar and Bayu Sumantri Agung (Yusuf-Bayu). The hearing was presided over by Deputy Chief Justice Saldi Isra (panel chair) and Constitutional Justices Ridwan Mansyur and Arsul Sani on panel 2 on Thursday, January 9, 2025.
In their petitum, the Petitioners requested the annulment of the Deli Serdang KPU (General Elections Commission) Decree No. 3098 of 2024 on the certification of the 2024 Deli Serdang regent election vote counting recapitulation. The Petitioners also requested that the Court order a revote in all of the polling stations in the regency within a maximum of 4 months after the Court’s decision.
“[The Petitioners requested the Court] to order the Deli Serdang KPU to conduct a revote for the 2024 regent election at all polling stations throughout Deli Serdang Regency within a maximum of 4 months after this Decision is handed down,” said Paujiah Hanum as the Petitioner’s legal counsel while reading the petitum.
Paujiah said the legal reason for the request was because Candidate Pair 2 Asri Ludin Tumbunan and Lom Lom Suwodo (Asri-Suwodo), who won the most votes, had committed structured, systematic, and massive (TSM) violations. She alleged that the violations include money politics, politicization of local government officials, involvement of village officials, and involvement of the election organizers.
“In the election, there were violations that were structured, systematic, and massive in the form of money politics, politicization of [local government officials], involvement of village officials, [and] involvement of election organizers by Candidate Pair 2,” said Paujiah while reading the key points of the petition.
The Petitioners called for a revote due to a natural disaster in the form of thunderstorms and flooding throughout Deli Serdang Regency, which led to low voter turnout at the polling stations. It was noted that only 32% participated in the election from the total of 1,439,399 in the final voters list.
“According to the data we obtained in the field, natural disasters [such as] thunderstorms caused polling stations to flood and/or prevented voters from turning out at the polling stations,” explained Paujiah.
