JAKARTA (MKRI) – The Constitutional Court (MK) held a preliminary hearing on Thursday, January 9, 2025 for case No. 240/PHPU.BUP-XXIII/2025 concerning Central Mamuju Regency election results dispute filed by Candidate Pair 02 Sahrul Sukardi-Alamsyah Arifin.
The preliminary hearing was presided over by Constitutional Justice Arief Hidayat (panel chair) and Constitutional Justices Enny Nurbaningsih and Daniel Yusmic Foekh on panel 3. The legal counsel, Julianto Asis stated in the hearing that he was resigning as a legal counsel for Sahrul Sukardi-Alamsyah Arifin.
“We would like to convey that our presence here is to resign as the legal counsel, Your Honor,” said Julianto in the panel 3 courtroom on Thursday, January 9, 2025.
Julianto explained that in their last communication, an agreement between the Petitioners and the legal counsel remained unfulfilled. He, along with three others, submitted a resignation letter as the legal counsel for Sahrul Sukardi-Alamsyah Arifin, which was presented at the hearing.
He added that Sahrul Sukardi has confirmed his resignation. However, it is difficult for them to make a call with Alamsyah Arifin, which means the resignation has not yet been approved.
“The deputy resides in a rural area with inconsistent signal coverage. Efforts have been made to contact his wife—both of them—and his relatives, but none have provided confirmation or seem to have any knowledge, Your Honor,” explained Julianto.
Constitutional Justice Arief stated that legal counsel is not required to file a petition from Sahrul Sukardi-Alamsyah Arifin because of the absence of confirmation. He added, this will be reported in the justice deliberation meeting (RPH).
In addition, he answered the question from the relevant party following the resignation. “It is not clear, What do you want to react to? Do you want to respond to an invisible petition? No, of course. Including the General Election Supervisory Body (Bawaslu), General Election Commission (KPU), this petition is considered non-existent” stated Constitutional Justice Arief.
Constitutional Justice Arief closes his statement by saying “There are two withdrawn petitions. One is withdrawn, one is unclear, and the other keeps remaining.”
The Petitioners file a petition to annul the Decree of Central Mamuju Regency KPU (General Election Commission) No. 611 concerning the certification of the 2024 Central Mamuju Regency election results, dated December 6, 2024.(*)
