JAKARTA (MKRI) – Candidate Pair 01 Erzaldi Rosman-Yuri Kemal Fadlullah revealed fraudulent practice in the 2024 Bangka Belitung Islands gubernatorial election. It was stated at the preliminary hearing for case No. 266/PHPU.GUB-XXIII/2025 concerning the dispute over Bangka Belitung gubernatorial election results. The preliminary hearing was presided over by Chief Justice Suhartoyo (panel chair) and Constitutional Justice Foekh and M. Guntur Hamzah on panel 1 on Thursday, January 9, 2025.
The Petitioners argued that Bangka Belitung Islands KPU (Elections Commission) as Respondent had committed fraudulent practices and violations at several polling stations (TPS).
They argued that the KPPS (polling station working committee) did not check listed voters’ electronic ID cards and the C-model forms. “This was ignored by the KPPS and occurred in many polling stations spread across many districts in Pangkalpinang City, South Bangka Regency, Bangka Regency, Central Bangka Regency, and West Bangka Regency,” said Yuri Kemal reading out the petition.
The Petitioners found many voters casting their votes outside their listed polling stations without showing voting relocation letters from the local polling committee (PPS). Such incidents were spread across several districts in South Bangka Regency, West Bangka Regency, Bangka Regency, Central Bangka Regency, and Pangkalpinang City.
Double Voting and Opened Ballot Boxes
Another fraudulent practice alleged by the Petitioners is duplicate voter data at various polling stations in Bangka Belitung Islands Province. The Petitioners claimed to have evidence related to this.
The Petitioners also said that several ballot boxes had been opened while voting was still ongoing. They argued that it had happened at TPS 005 of Kejaksaan Village in Taman Sari District, Pangkalpinang City.
“Ballot boxes were opened while voting was taking place, citing a mistake in inserting ballots, which should have gone into the ballot boxes for the mayoral candidate pairs, but were instead put into the ballot boxes for the gubernatorial candidate pairs,” said Yuri.
Bawaslu’s Recommendation
The Petitioners reported those fraudulent practices to the Bangka Regency Bawaslu (Elections Supervisory Body), who then assessed that the alleged violations in many polling stations in several districts in Bangka Regency were ground for a revote. Therefore, they issued Letter Number 385/PM.00.02/K.BB-01/12/2024 concerning the recommendation for a revote.
According to the Petitioners, the recommendation must be followed up with a revote at various polling stations in Sungailiat District, Belinyu District, and West Mendo District with a total of 16,412 final voters and 5,600 valid votes.
Due to this recommendation, the Petitioners filed a petition so that the Court would order the Respondent to conduct a revote.
“The Petitioners request the Court to issue the following decision: ordering the Respondent to conduct a revote at polling stations in five regencies or cities, 31 districts, and 400 polling stations,” said Yuri.
They also requested that the Court declare the Bangka Belitung Islands Provincial KPU Decree Number 77 of 2024 concerning the certification of the results of the 2024 Bangka Belitung gubernatorial election null and void and has no binding legal force as long as it concerns the votes acquisition at 400 polling stations in 31 districts across five regencies or cities.
The panel asked whether the Bangka Regency Bawaslu’s recommendation of a revote had not been implemented by the KPU (Respondent), which the Petitioners confirmed.
“Has [the recommendation] not been implemented yet or has?” asked Chief Justice Suhartoyo.
“It has not been implemented, Your Honor. At that time, the Bangka KPU issued a letter stating that there was an ambiguity in Bawaslu’s statement, which regional election [was referred to], the regency or gubernatorial election,” answered Yuri.
The Panel then requested that the Respondent, Relevant Parties, and Bawaslu provide a response at the next hearing.
