JAKARTA, MKRI - The Court (MK) postponed the hearing for the petition of Case Number 146/PHPU.WAKO-XXIII/2025 was filed by the Indonesian Human Rights Analysis Institute which also registered as a regional head election (pilkada) monitor in Tarakan City. This is because there are double petitions from the same party.
“There was a petition filed and then suddenly another on behalf of the organization withdrew the petition. We want to get the first one who filed the petition,” said Deputy Chief Justice Saldi Isra the leader of Panel 2 Justice, accompanied by Constitutional Justices Ridwan Mansyur and Arsul Sani in the preliminary hearing of the Tarakan Mayor Election Result Dispute on Thursday, January 9, 2025.
In the petition for Case Number 146/PHPU.WAKO-XXIII/2025, Ambo Tuwo as the Chairperson of the Indonesian Human Rights Analysis Institute acting as the Petitioner. Ambu Tuwo authorized Muklis and Angga Bursa Lesmana, who were present in the Courtroom, to continue the PHPU petition for the Mayor of Tarakan City.
“So we hope that with all kinds of wisdom from Your Honour, this petition will be continued because those who revoked it are no longer legal,” stated Muklis.
For this reason, Justice Saldi said, the Court considered this petition was not filed but was also not considered non-existent. The Court requests the KPU Tarakan City and Related Parties to respond to this issue and will study it in detail and present it at the next hearing.
“So this does not mean [the petition is] withdrawn or not withdrawn, we are in a status quo position. We will study it, including asking the KPU who registered as monitors at the KPU, it must be clear because that is the basis that can be the reason to submit to the Constitutional Court,” argued Constitutional Justice Saldi.
The petitioner in this case did not read out its petition in today's hearing, but it is not dismissed [the petition]. The Court will convey its position in the next hearing by first studying the case of the dispute over the management of the relevant monitoring institution.
The Petitioner requests the Court that the unpictured column be declared as the winner of the 2024 Tarakan Mayoral Election. The Petitioner suspects that the Candidate Pair (Paslon) for Mayor and Deputy Mayor of Tarakan Khairul and Ibnu Saud have committed various violations such as making changes to the state civil apparatus (ASN) six months before the register as the participant in the election.(*)
