JAKARTA, MKRI - The replacement of Civil Servant officials within six months before the determination of the candidate pair until the end of their term of office is believed to have impacted the results of the 2024 Banyuwangi Regent and Deputy Regent Elections. Candidate Pair Number 2, Moh Ali Makki and Ali Ruchi (Makki-Ali), is the Petitioner for Case Number 119/PHPU.BUP-XXIII/2025. The preliminary hearing for the Regent Election Results Dispute of Pamekasan Regency was held on Wednesday, January 8, 2025, in Panel 2 Courtroom.

The Petitioner's legal reason for requesting the Court to annul the Banyuwangi certification of election results is because Candidate Pair Number 1 Ipuk Feistiandani and Mujiono (Ipuk-Mujiono) have committed violations that are structured, systematic, and massive (TSM). This is evidenced by the replacement of officials 6 months before the date of declaration of the candidate pair.

“The Regent of Banyuwangi Regency as the incumbent has conducted violations through the Selection Committee for Primary High Leadership Positions,” said Badawi.

"Candidate Pair Ipuk-Mujiono, as the incumbent Regent, also abused their authority by using programs and activities to benefit themselves, while discrediting Candidate Pair Makki-Ali. The Regent of Banyuwangi Regency as an incumbent had abused authority for personal gain,” add Badawi.

Badawi also stated that the form of TSM violations that occurred was the alignment of the Banyuwangi Bawaslu towards winning the Ipuk-Mujiono Candidate Pair. The Chairman of Bawaslu Banyuwangi himself insisted that candidate pair Ipuk-Mujion must win in the 2024 Banyuwangi Regency Election.

“The partiality and/or non-neutrality of the Chairperson of Banyuwangi Regency Bawaslu for Candidate Pair Number 1 winning, as stated in the Statement Letter dated November 29, 2024, made and signed by the initial SHM which states ‘I don't want to know, 01 must win, this is an order from Above’,” Badawi stated.

Therefore, in its petition, the Petitioner requested the Court to declare that the Incumbent had abused authority by using programs and activities that benefited or harmed one of the candidate pairs both in his area and other areas. In addition, the Court is asked to order the Banyuwangi Regency General Election Committee (KPU) to cancel candidate pair number 01 (Ipuk Fiestiandani Azwar Anas and Ir. Mujiono, M.Si) as a participant in the 2024 Banyuwangi Regent Elections. (*)
