Petitioner's Absence Leads to Dismissal of Lingga Regent Election Results Dispute

JAKARTA, (MKRI) - The Constitutional Court (MK) held a preliminary hearing of the 2024 Lingga Regency election results dispute Lingga for Case Number 116/PHPU.BUP-XXIII/2025 on Wednesday, January 8, 2025. The hearing was held in Panel Room 3, Building 1 of the Constitutional Court, chaired by Constitutional Justice Arief Hidayat, accompanied by Constitutional Justices Enny Nurbaningsih and Ridwan Mansyur.

The Petitioner, Candidate Pair Number 2, Alias Wello-Muhammad Ishak, and his legal counsel decree in absence. Constitutional Justice Arief Hidayat  as Panel chair, declared the petition dismissed.

"Petition 116. However, Petition 116 does not exist. [The Court] views this [as the Petitioners] not being serious [in filing the petition]. [The Petition] dismissed, [petition] Lingga Regency," said Justice Arief in Panel 3 of the Courtroom, Jakarta.

The Petitioner argued in their petition that the vote acquisition by the regent and deputy regent candidate pair number 1, Muhammad Nizar-Novrizal, did not adhere to the principles of direct, general, free, secret, honest, and fair elections. These principles are enshrined in Article 22E paragraph (1) of the 1945 Constitution of the Republic of Indonesia (UUD NRI).

Based on the results of the certification of the General Election Commission (KPU) of Lingga Regency as the Respondent, the candidate pair Muhammad Nizar-Novrizal secured 33,615 votes, while the Petitioner, Alias Wello-Muhammad Ishak, received 18,476 votes.

The Petitioner alleged that structured, systematic, and massive (TSM) violations were committed by the incumbent regent candidate pair, Muhammad Nizar-Novrizal, in the Lingga Regency election. These violations reportedly included abuse of authority and misappropriation of programs. Among the allegations was the use of the regional revenue and expenditure budget (APBD) grant program through the Indonesian Red Cross (PMI) of Lingga Regency to benefit and secure votes for candidate pair number 1.

The Petitioner also highlighted the abuse of authority by the incumbent, mentioning the use of a Lingga Regency government ambulance that was parked at the campaign team post of Muhammad Nizar-Novrizal. This violates Article 69 h and j of Law Number 1 the Year 2015 on the Stipulation of Government Regulation instead of Law Number 1 the Year 2014 on the Election of Governors, Regents, and Mayors.
