JAKARTA (MKRI) The Pribumi Unity Movement (Genpabumi) requested the annulment of the KPU (General Elections Commission) Decree No. 2752 of 2024 on certification of the Gresik regent election results dated December 4, 2024 to the Constitutional Court (MK). The hearing took place on Wednesday, January 8, 2025 and was presided over by the Chief Justice Suhartoyo (panel chair) and Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah on panel 1.

At the hearing for case No. 131/PHPU.BUP-XXIII/2025, legal counsel Moh. Irfan Khoiri stated that the votes obtained by Candidate Pair 01 Fandi Ahmad Yani and Asluchul Alif totaled 366,944. Meanwhile, there were 247,479 blank votes and 35,749 invalid votes. A total of 650,172 voters have turned out, out of 971,740 eligible final voters.

The blank vote’s defeat, the Petitioner asserted, was due to lack of information from the KPU to the community, especially in twelve districts: Driyorejo, Palongpanggang, Wringin Anom, Kedamean, Menganti, Benjeng, Cerme, Duduk Sampeyan, Dukun, Panceng, Sangkapura, and Tambak.

“The morning walk event by the campaign team of Candidate Pair 01 was part of money politics in the districts. Candidate Pair 01 [mobilized] the village heads. Although there are only 4 pieces of evidence, at this first hearing, there is additional evidence related to money politics,” explained Irfan in the plenary courtroom.

Irfan further explained that the constitutional principle of free elections was not fulfilled because the public did not recognize that a blank vote exists. Therefore, many of them did not cast their vote.

The Petitioner requested that the Court order the Gresik Regency KPU to certify the blank vote as the election winner and to order it to conduct a revote in Menganti, Driyorejo, Wringin Anom, Cerme, Benjeng, and Balongpanggang Districts.
