JAKARTA, MKRI - Candidate Pair Number 3 Dedy Ermansyah and Nuragiyanti Dewi as the Petitioners of case No. 102/PHPU.WAKO-XXIII/2025 withdrew the petition on dispute over the election results of the 2024 Bengkulu mayoral election. This was conveyed by the chair of Panel 2, Deputy Chief Justice Saldi Isra at a preliminary hearing on Wednesday, January 8, 2024.
JAKARTA, MKRI - The Candidate Pair Number 3 Dedy Ermansyah and Nuragiyanti Dewi as the petitioner of case number 102/PHPU.WAKO-XXIII/2025 withdrew the petition on dispute over the election results of the 2024 Bengkulu Mayoral Election. This was conveyed by the chair of Panel 2, Deputy Chairman of the Constitutional Court (MK) Saldi Isra in a preliminary hearing on Wednesday, January 08, 2024.
“(Perkara Nomor) 102 tidak hadir dan sudah menarik permohonan,” ujar Saldi di Ruang Sidang Gedung II MK, Jakarta. Dalam Panel 2, Saldi memimpin persidangan didampingi Hakim Konstitusi Ridwan Mansyur dan Hakim Konstitusi Arsul Sani.

Sebagai informasi, dalam permohonannya Dedy-Dewi mendalilkan adanya dugaan penggunaan dana anggaran pendapatan dan belanja daerah (APBD) oleh paslon petahana Dedy Wahyudi dan Ronny Tobing dalam Pemilihan Walikota (Pilwalkot) Bengkulu. Menurut Pemohon, setiap dinas diinstruksikan untuk melakukan penggalangan dana guna memenangkan Paslon Nomor Urut 5 Dedy-Ronny.

Pemohon menjelaskan, modusnya dengan pemotongan anggaran kegiatan, anggaran rutin, dan perjalanan dinas di setiap organisasi perangkat daerah (OPD). Dana yang dikumpulkan tersebut akan digunakan untuk politik uang atau money politics untuk pemenangan Paslon Dedy-Ronny. Misalnya, kepala dinas pendidikan Kota Bengkulu mengumpulkan dana kemudian melaksanakan modus dengan mengumpulkan kepala sekolah SD dan SMP untuk meminta data guru-guru dan aparatur sipil negara (ASN) yang ada di sekolah dan meminta setiap kepala sekolah untuk menyerahkan minimal 50 nama dari keluarga dan guru-guru guna memilih Paslon Dedy-Ronny.

Pengerahan kepala sekolah dan guru yang dimobilisasi kepala dinas pendidikan Kota Bengkulu tersebut nantinya akan diberikan uang Rp 100 ribu untuk setiap orang menggunakan dana yang diduga digalang dari setiap dinas tersebut sebelum pencoblosan. Pemohon juga menyebut terjadi kecurangan dengan mengkondisikan camat, lurah, dan RT untuk memenangkan Paslon Dedy-Ronny. Dugaan penggunaan APBD Kota Bengkulu untuk pemenangan Paslon 5 Dedy Wahyudi-Ronny Tobing telah bertentangan dengan netralitas ASN dan semangat pemberantasan korupsi, kolusi, dan nepotisme.

Dalam petitumnya, Pemohon memohon kepada Mahkamah untuk membatalkan Keputusan Komisi Pemilihan Umum Kota Bengkulu Nomor 478 Tahun 2014 tentang Penetapan Pasangan Calon Peserta Pilwalkot Bengkulu tertanggal 22 September 2024; menyatakan Pemohon sebagai pemenang dalam Pilwalkot Bengkulu Tahun 2024; memerintahkan Termohon untuk mendiskualifikasi Paslon Dedy Wahyudi-Ronny Tobing; serta memerintahkan KPU Kota Bengkulu untuk mengadakan pemungutan suara ulang di Kota Bengkulu.

In its petition, the Petitioner requests the Court to annul the certification of election results of Bengkulu City No. 478/2014 for Bengkulu Majoral Election dated September 22, 2024; declare the Petitioner as the winner; order the Respondent to disqualify Candidate Pair Dedy Wahyudi-Ronny Tobing; and order the KPU to hold a re-vote.
