JAKARTA (MKRI) – The Constitutional Court (MK) held a preliminary hearing for Case Number 187/PHPU.BUP-XXIII/2025 concerning General Election Results Dispute (PHPU) for the regent-vice regent of Cirebon, West Java on Wednesday, January 8, 2025. It was presided over by the Chief Justice Suhartoyo (panel chair) and Constitutional Justices Foekh and M. Guntur Hamzah on panel court 1.
The petition was filed by Candidate Pair 04 Mohammad Luthfi-Dia Ramayana represented by their legal counsels, Achmad Faozan TZ. Meanwhile, the Respondent was the General Election Commission (KPU) and the Relevant Party was Candidate Pair 02 Imron-Agus Kurniawan.
Mohammad Luthfi and Dia Ramayana (the Petitioner) alleged irregularities of voters as they found forged signatures on the attendance lists at various polling stations in Cirebon. Those were allegedly falsified with the same signature pattern, "For example, those were initialed or in a straight line," said Faozan when reading the petition.
In addition, the Petitioners argued that some voters were registered as Indonesian migrant workers (PMI) and were not in Indonesia during the election. However, their signatures were found on the attendance lists.
From the allegation, the Petitioners suspect the involvement of election organizers at the polling station level. They stated that the alleged manipulation of signatures was part of a structured, systematic, and massive (TSM) violation.
"It is suspected that the election organizers at the polling station level committed the crime of falsifying signatures on the attendance list massively, at approximately 600 TPS spread across 31 districts in Cirebon Regency," said Faozan.
Moreover, the Petitioner alleged the involvement of civil servants in Cirebon Regency from the village to district levels. Such actions, according to the Petitioners, have violated the provisions in the General Election Commission Regulation (PKPU) No. 12 of 2010 concerning Guidelines for Procedures for Updating Data and Voter Lists in the General Election of Regional Heads and Deputy Regional Heads.
Therefore, the Petitioners requested that the Court declare the Decision of the Cirebon Regency General Election Commission 325/PL.01.8-BA/3209/2/2024 dated December 5, 2024 null and void.
